Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
The promoter is The Smith's Snackfood Company Pty Limited (ABN: 31 057 976 940) of Tower A, Level 4, 799 Pacific Highway, Chatswood, NSW 2067, telephone: 1800 025 789, in Australia and Bluebird Foods Limited (Company No. 163343) of 124 Wiri Station Road, Manukau, Auckland 2104, in New Zealand (together, "Promoter").
Entry is only open to Australian and New Zealand residents aged 18 years or older.
Employees (and their immediate families) of the Promoter, participating stores and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences on 01/05/2018 and ends at 11:59pm AEST on 30/06/2018 ("Promotional Period").
To enter, individuals must complete the following steps during the Promotional Period:
Purchase any participating Doritos product (excluding salsas/dips) listed in clause 7 below ("Participating Products") from a participating store in Australia or New Zealand and retain their purchase receipt. All stores in Australia and New Zealand that stock and sell Participating Products will be participating stores for the purposes of this promotion; and then
visit www.doritos.com.au and follow the prompts to access the entry page, input the requested details on the entry page (including their full name, a valid email address, mobile number, date of birth, Australian or New Zealand postal address, their full purchase receipt number and the last 6 digits of the product barcode number of the Participating Product purchased), and submit the fully completed entry form.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete or indecipherable entries will be deemed invalid. Entries are deemed to be received at the time of receipt into the promotional database and not at the time of submission. The Promoter accepts no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over communications networks or services, the Internet, or computer or telephone networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.
Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Participating Product purchased; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) a maximum of two (2) entries permitted per person per day.
Entrants must retain either their original purchase receipt(s) OR a copy of their purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for each entry submitted when requested may, in the absolute discretion of the Promoter, result in invalidation of all entries submitted by the entrant and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase that a Participating Product was purchased and show that the purchase was made during the Promotional Period but prior to entry.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. Proof considered suitable for verification is at the Promoter’s sole discretion.
There will be one (1) draw conducted for the entries received each day of the Promotional Period, for a total of sixty one (61) draws ("Daily Draw/s"), and there will be one (1) draw conducted for all entries received during the Promotional Period ("Major Draw"). Entries into each Daily Draw will open and close each day based on NSW local time. Entries in each Daily Draw will NOT be entered into any subsequent Daily Draw(s), however, all entries (including the Daily Draw winners) will be entered into the Major Draw.
All draws will take place at Tactics Marketing, Unit 6, 106 Old Pittwater Road, Sydney, NSW 2100. Each Daily Draw will take place at 12pm AEST on the first business day after entries close for that Daily Draw, with the first Daily Draw taking place on 02/05/2018 and the last Daily Draw taking place on 02/07/2018. The Major Draw will take place at 12pm AEST on 02/07/2018. For the removal of doubt, no draws will be conducted during the weekend or on a public holiday in NSW.
The winners will be notified in writing within two (2) business days of the relevant draw and their names will be published at www.doritos.com.au/jurassicworld from 04/07/2018.
The first valid entrant drawn in the Major Draw will win a trip to Hawaii, USA, for the winner and one adult companion (aged 18 or over), valued at up to AU$15,000 including GST ("Major Prize"), depending on date and point of departure. The prize will be awarded as a credit redeemable through The Marketing Syndicate on behalf of the Promoter. A representative of The Marketing Syndicate will liaise with the winner to create and book their trip. The Marketing Syndicate will use its best endeavours to book the winner’s itinerary preferences, subject to availability, feasibility, Australian Government travel advice and any other matters The Marketing Syndicate and/or the Promoter consider appropriate. The Promoter’s and the Marketing Syndicate’s decision with respect to all elements of booking the Major Prize is final and no correspondence will be entered into. For the removal of doubt, any unused balance of the $15,000 credit will be forfeited and will not be redeemable for cash. The Major Prize includes the following:
Return economy flights for two (2) adults from the winner’s nearest Australian capital city (if the winner is from Australia) or from the nearest New Zealand capital city (if the winner is from New Zealand) to Hawaii, USA;
Four (4) nights’ 4 star accommodation in Hawaii for two (2) adults, with the exact hotel selected by the Promoter in its discretion; and
Breakfast on each day of hotel stay, at the hotel (on a set menu).
The Major Prize is subject to the following terms and conditions, as well as the standard terms and conditions of individual prize and service providers:
All flights and accommodation are subject to availability at all times and may be dependent on selected seat class with airlines or specific room category availability with accommodation partner.
Travel must be booked by 02/07/2019 and completed by 02/01/2020. Winner must provide at least three (3) weeks’ prior notice of preferred travel dates.
Major Prize is not redeemable for cash or cash products ie, Travelex, foreign currency etc.
Redeeming the Major Prize is conditional on acceptance of the terms and conditions of travel and the airline carriers in accordance with normal travel practices.
The Major Prize is non refundable or transferable.
The winner and their travel companion are responsible for ensuring that they have all necessary documents to travel to the chosen destination, including a valid passport with a minimum of 6 months validity from the date of their return flight and any visas that may be required for international destinations.
The winner and their companion are responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed.
All other costs associated with the Major Prize, including but not limited to visas, valid passports, transfer costs, taxes (excluding airport/airline taxes), spending money, meals (other than those listed as included) and any other ancillary costs, including but not limited to insurance and any applicable insurance excesses, not listed in the travel prize package descriptions above are the responsibility of the winner and his/her nominated traveling companion as incurred.
The Promoter recommends that the winner and their travel companion have appropriate travel insurance for their period of travel. It is the responsibility of the winner and their companion to arrange appropriate travel insurance at their own cost.
Frequent flyer points will not form part of the Major Prize.
The winner and their companion must travel together, from/to the same departure/arrival points, and take all elements of the prize together, at the same time.
The winner may be required to present their credit card at time of accommodation check in and winner is responsible for all incidentals.
The first valid entrant drawn in each Daily Draw will each win a $500 Visa Gift Card ("Daily Prize"). The Daily Prize will be awarded in the winner’s local currency (i.e. AU$500 if a winner is from Australia and NZ$500 if a winner is from New Zealand).
Visa Gift Cards will be delivered to the winners within twenty eight (28) days of verification of their entry, to the Australian or New Zealand mailing address provided with their entry. To the extent permitted by law, once any prize has left the Promoter’s (or supplier’s) premises, the Promoter will not be responsible for any delay in delivery, loss or damage to the prize. Any ancillary costs associated with redeeming the gift card are not included. Any unused balance of the gift card will not be awarded as cash. Redemption of the gift card is subject to any terms and conditions of the issuer including those specified on the gift card. Gift cards are valid for twelve (12) months from date of issue. Visa Gift Cards can be used for purchasing goods and services where Visa Prepaid Cards are accepted for electronic transactions (excluding transactions at ATMs or over the counter at financial institutions). The Card is not a credit card, nor is it linked to a deposit account. Visa Gift Card cannot be used for cash advances, cannot be redeemed for cash and cannot be returned for a refund. The Promoter’s decision with respect to all elements of this promotion is final and no correspondence will be entered into.
Subject to the unclaimed prize draw clause, if for any reason a winner does not take / redeem a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value is up to AU$45,500.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash. The Promoter accepts no responsibility for any variation in the value of a prize.
A draw for any unclaimed prizes may take place on 02/10/2018 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified in writing within two (2) business days of the draw and their names will be published at www.doritos.com.au/jurassicworld from 05/10/2018.
The Promoter may, in its sole discretion, disqualify any or all entries from, and prohibit further participation in this promotion by, any person who fails to provide adequate identification to the satisfaction of the Promoter, or who tampers with or benefits from the manipulation of, or tampering with, the entry process or the operation of the promotion or acts in violation of these Terms and Conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
If for any reason any aspect of this promotion is not capable of running as planned, including by way of war, terrorism, state of emergency, disaster, tampering or computer virus, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority. As a condition of accepting a prize, each prize winner may be required to, at the Promoter’s request, participate in promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
The Promoter and its associated agencies and companies (including each of their respective officers, employees and agents) will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) by any person in connection with this promotion or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
Entrants acknowledge that there are inherent risks in some aspects of the Major Prize. By entering this promotion and accepting the Major Prize, entrants accept that risk for and on behalf of themselves and their companion. As a condition of accepting the Major Prize, the winner of the Major Prize (and their companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. If a winner or their companion does not sign such documentation within the time requested by the Promoter, the winner will forfeit the Major Prize.
The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
The information entrants provide will be used by the Promoter for the purpose of conducting this promotion. By entering this promotion, entrants consent to the storage of their personal information on the databases of the Promoter and its related bodies corporate and the Promoter and its related bodies corporate may use this information for future promotional and marketing purposes regarding their products and services including (where the entrant has opted in) contacting entrants via electronic messaging. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this promotion or communicating with entrants.
