Information on how to enter and the prize form part of these Terms and Conditions. By participating, entrants agree to be bound by these Terms and Conditions.
Entry is open to Australian residents 16 years and over who can travel to the United States of America (if drawn as a winner). Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter. Employees (and their immediate families) of the Promoterand agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences on the 28th of September 2017 and closes at 11:59pm AEDST on the 12th of November 2017 (“Promotional Period.”)
To be eligible to enter, individuals must undertake the following steps during the Promotional Period:

Incomplete, indecipherableor illegible entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of thepromotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
The draw will take place at Bauer Media, Building 8, 658 Church Street Richmond, 3121,Victoria, on the 13th of November 2017 at 11:00am AEDST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winner will be notified via telephone and email within two (2) business days of the draw and their name will be announced online at www.cosmopolitan.com.au/ripcurl from 17th November 2017.
The first valid entry drawn from all valid entries received will win the prize of a trip for two (2) people to Los Angeles, USA valued at up to AUD$10,000 depending on date and point of departure. Prize includes:
Return economy class airfares from the winner’s nearest Australian Capital City to Los Angeles, USA for two (2) people;
Five (5) nights twin share accommodation staying at Kimpton Shorebreak Hotel, Huntington Beach;
Return airport to hotel transfers;
A two (2) hour private group surfing lesson for two (2) people with a professional surfer;
AUD$1,000 spending money for the winner only; and
Travel insurance (Aussie Travel Cover – Mid International Policy) for two (2) people, subject to all travellers having no pre-existing medical conditions and being aged between 18 to 75 years. AUD$150 excess applies to any claims made.
Additional spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be booked by 30th December 2017, taken by 30th October 2018 and is subject to booking and flight availability. Prize cannot be taken between 1st December 2017 and 31st January 2018. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. The winner and his/her companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. The winner and his/her companion must depart from and return to the same departure point and travel together. Frequent flyer points will not form part of the prize. The winner may be required to present their credit card at time of accommodation check in.
The winner and his/her companion will each be required to fully complete a travel insurance application form provided by the Promoter, and may also be required to undergo medical tests as required by the Promoter’s nominated travel insurer, in order to redeem the travel insurance element of the prize. Any person found guilty of insurance fraud or failure to honestly and accurately disclose all relevant insurance information at the time of applying for a travel insurance policy or when making a claim forfeits any rights or entitlements to the travel insurance element of the prize. Travel insurance will be provided by the Promoter’s nominated travel insurer, and subject to approval by the travel insurer. In the event that the Promoter’s nominated travel insurer refuses to issue insurance to the winner and/or companion, the winner forfeits that travel insurance element of the prize. Travel insurance is subject to the terms and conditions issued by the Promoter’s nominated travel insurer, including but not limited to any limitations on the covered amount.
As a condition of accepting the prize the winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event a winner or winner’s companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
The prize, or any unused portion of the prize, is not transferable, exchangeable and cannot be redeemed as cash, unless otherwise stated.
If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian on behalf of the winner. It is the responsibility of the winner’s parent/legal guardian to prove their parental status/ legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winners parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to and administrative fees incurred by the Promoter). Where relevant, the Promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. The Promoter is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the winner and their respective parent/s and/or legal guardian/s.
Prize is subject to the standard terms and conditions of individual prize and service providers.
In the event that for any reason whatsoever the winner does not take the prize (or a part of the prize) at the time stipulated by the Promoter, then the prize (or that part of the prize) will be forfeited by the winner and cash will not be awarded in lieu of the prize.
In the event that the prize, or part of the prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.
In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)the Promoter reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.
If necessary, an unclaimed prize draw will be held on the 13th February 2018 at the same time and place as the original draw, in order to distribute the prize if unclaimed, subject to any directions from a regulatory authority. The winner (if one is required) will be notified via telephone and email within two (2) business days of the draw and their name will be announced online at www.cosmopolitan.com.au/ripcurl from 16th February 2018.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities.
