What’s your NZ Pinot Personality Terms and Conditions
- Information on how to enter the ‘What’s your NZ Pinot Personality?’ promotion (“this Promotion”) and details of Promotion prizes form part of these Terms and Conditions (“Conditions”).
- Participation in this Promotion is deemed acceptance of these Conditions.
- The Promotion commences 09:00AM AEST 24/09/2018. Entries close 11:59PM AEDT 31/10/2018 (“Promotion Period”).
- The Promoter is New Zealand Winegrowers Incorporated trading as New Zealand Winegrowers (ABN 90 441 010 955) of Level 4, 45 William Street, Melbourne VIC 3000.
- Entry is open to Australian residents living in the States of New South Wales, Victoria and Queensland only aged 18 years and over at the time of entering the promotion. Employees of the Promoter and agencies associated with this Promotion (and their immediate families) are ineligible to enter.
- The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions.
- Multiple entries per person are permitted as long as each entry fulfils the requirements of entry and is submitted in accordance with these Conditions.
- The Promoter accepts no responsibility for late, lost or misdirected entries.
- To enter, entrants must, during the Promotion Period:
- go to nzpinotpersonality.com (“Website”);
- take the New Zealand Pinot Personality online quiz;
- at the conclusion of the quiz, complete the online entry form, including providing contact details and other information as requested by the Promoter; and.
- click on submit to finalise their entry.
- By providing an email address, the participant confirms they are the authorised owner/user of the email address submitted.
- All entries are deemed to be received by the Promoter at the time of receipt into the promotion database, and not at the time of transmission by the entrant.
- By entering the promotion, each entrant consents to receive email communications from New Zealand Winegrowers and may unsubscribe at any time.
- There is only one (1) winner of the Prize in total.
- return, economy class international flights to Queenstown New Zealand for two (2) adults with Air New Zealand, departing from Melbourne, Sydney or Brisbane, valued at up to $2,000 AUD (depending on the winner’s place of residence);
- four (4) nights’ accommodation with a provider of the Promoter’s choice, valued at up to $1,000 AUD;
- four (4) days’ rental car with a provider of the Promotor’s choice, valued at up to $500 AUD; and
- a full day “regional experience” itinerary organized by the local Regional Tourism Operator, valued at up to $1,000 AUD,together “the Prize”. Total Prize value is up to $4,500 AUD (RRP, including GST). The Promoter accepts no responsibility for any variation in the prize value. Prizes or any unused portion of a prize are not transferable or exchangeable and cannot be taken as cash.
- All travel must be completed before 30 June 2019. All travel is subject to availability at all times and may be dependent on the availability of select seat classes (in the case of flights) or specific room categories (in the case of accommodation partners). Travel is not permitted on Public Holidays or between the December 10 2018 and January 15 2019 peak. Other blackout periods may apply and will be notified to the winner at the time of booking. The Prize must be confirmed and booked by 28 February 2019. Once the booking is confirmed, no change to travel dates is permitted. The Promoter will do everything within its reasonable power to accommodate desired dates within the constraints of the Promotion.
- The winner and their travel companion must hold a current passport with a minimum of 6 months’ validity from the departure date. The winner and their travel companion must have valid travel insurance for the duration of their travel. The winner and their travel companion are responsible to ensure that they have appropriate travel documentation to enable them to travel to New Zealand and are solely responsible for the cost of obtaining them (if required).
- All bookings and documentation regarding the prize must be made to the Promoter’s nominated booking agent. Redeeming the prize is conditional on acceptance of the terms and conditions of travel as detailed by the booking agent (which will be provided to the winner at the time of awarding the prize) and airline carriers in accordance with normal travel practices.
- All other costs associated with taking the Prize (including meals, beverages, laundry services, spending money, transport to and from departure point, insurance, travel insurance, visas and all other ancillary costs not expressly included in the Prize description, as well as the costs of obtaining any of these) are the responsibility of the winner and their travel companion.
- The Prize draw will be conducted at the offices of the Promoter, Level 4, 45 William St, Melbourne, Vic, 3000, Australia at 9am AEDT on 5th of November 2018. The Promoter reserves the right to draw an additional nine (9) reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. If an invalid entry or ineligible entrant is drawn, the relevant prize will be awarded to the first reserve entry drawn. This process will continue until a clear winner is determined.
- The winner will be notified in writing via email within two business days of the draw, and must follow the instructions included in that email in order to claim their prize. If requested by the Promoter, entrants must provide proof of identity, proof of age and proof of residency to verify their entry (“Proof of Identity”). Identification considered suitable for verification is at the Promoter’s discretion. If an entrant/winner fails to provide Proof of Identity by the time and date stipulated by the Promoter, their entry/prize claim will be deemed invalid at the Promoter’s discretion. The Promoter’s decisions are final and no correspondence will be entered into.
- Once the winner is deemed by the Promoter to have complied with these Conditions, the Promoter will deliver the relevant prize within 28 days of the winner’s entry being verified and accepted.
- The winner’s name and state of residence will be published on the Promoter’s Australian Instagram page (@nzwineaus) and the Website on 12th November 2018. The Promoter’s decisions in respect of the promotion are final and no further correspondence will be entered into (subject to any directions from a relevant authority).
- The Prize must be claimed by 5pm AEDT on 5th February 2019. If the prize is not claimed by this date, the Promoter will conduct an unclaimed prize draw at 9.00am AEDT on 6th February 2019. The winner of the unclaimed prize draw will be contacted in writing by email within two business days of the unclaimed prize draw, and their name published on the Promoter’s Australian Instagram page and Website on 13th February 2019.
- In the event that the Prize, or an element of the Prize, is/are not available, the Promoter reserves the right to substitute the Prize or that element of it in its discretion to the same and equal recommended retail value and/ or specification subject to any written directions from relevant state regulatory authorities.
- If for any reason this Promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this competition (“Interference”), the Promoter reserves the right in its sole discretion to disqualify any individual who has caused or contributed to the Interference, and, subject to any written directions given by relevant state regulatory authorities, to cancel, terminate, modify or suspend the Promotion.
- The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participant’s or any other person’s computer related to or resulting from participation in or downloading any materials in this Promotion.
- Any costs associated with accessing the competition Website is the entrant’s responsibility and is dependent on the Internet service provider used.
- Except as expressly set-out in these Conditions and otherwise to the maximum extent permitted by law, the Promoter provides the prize on an “as is” basis and excludes any and all warranties, representations, implied terms and/or liability for any direct costs, losses, damages or expenses of any nature whatsoever (“Loss”) and any claims, actions, or demands in relation to any of the foregoing howsoever caused or claims of the prize winner or any other person (including in negligence) arising in connection with the prize or these Conditions.
- In respect of any liability of the Promoter which cannot be excluded, the Promoter limits its liability (to the maximum extent permitted by law):
- under any applicable consumer guarantees in the Australian Consumer Law in relation to the supply of the prize to either, at the Promoter’s discretion, the supply of the relevant prize again or the payment of the cost of having the prize supplied again; and
- for breach of agreement, negligence, breach of statutory duty or any other cause of action other than a breach of an applicable consumer guarantee (regardless of how that liability is caused), arising under these Conditions or related to any prize, to the lesser of the prize value or the minimum amount permitted by law.
- The winner continuously indemnifies the Promoter, and its directors, employees, agents, suppliers, clients, and assigns (Indemnified Parties) for and against any Loss, damage, cost (including legal costs on a full indemnity basis), or claim (including third party claims and claims in negligence) suffered or incurred by the Indemnified Parties and arising from or in connection with the winner’s: (a) breach of these Conditions of Entry or any relevant law; (b) negligent act or omission; or (c) action or omission causing personal injury or death.
- The Promoter will not be liable for any consequential, collateral, special, incidental, indirect, exemplary or punitive damages, including, without limitation, loss of profits or revenue, loss of opportunity or loss or destruction of data, costs of cover, costs of delay, however caused and based on any theory of liability, for any claims or causes of action arising out of or related to these Conditions or the Prize.
- In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion subject to any written directions from relevant regulatory authorities.
- The Promoter shall not be liable for any part of the Prize that has been lost, stolen, forged, damaged or tampered with in any way.
- The Promoter collects the winner’s personal information in order to conduct the Promotion. If the information requested is not provided, the entrant may not participate in the Promotion. By entering the Promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. The winner’s personal information may be disclosed to relevant regulatory authorities and the winner’s name published as required under applicable laws. The information you provide will only be used in the ways outlined in these Conditions The entrant can make a request to the Promoter for access to or the update, correction or erasure of their information at any time after the closing of the Promotion at their address set out in these Conditions. - Upon entering the Promotion you may be given the opportunity to send emails to the Promoter or enter or provide information or material (“Content”). Any and all Content provided by you in connection with the Promoter or the Promotion must be true and accurate. You must not misrepresent your identity or affiliation with any person or entity.
- Entrants consent to the Promoter using the entrant’s name, likeness, image and/or voice (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- The Promoter reserves the right to request entrants to provide proof of age, identity and residency. Identification considered suitable for verification is at the discretion of the Promoter.
- This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or Twitter. Entrants understand that they are providing their information to the Promoter and not to Facebook, Instagram or Twitter. Any questions, comments or complaints regarding the Promotion must be directed to the Promoter and not to Facebook, Instagram or Twitter.
