1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. The promoter is Roadshow Films Pty Ltd (ABN: 28 100 746 870) of 1 Garden Street South Yarra VIC 3141, telephone: 03 9281 1000 (“Promoter”).
3. Entry is only open to Australian residents aged 18 years or over who can take the prizes on the nominated dates, if drawn as the prize winner.
4. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. Promotion starts on 06/11/2017 and entries close at 11.59am AEDST on 01/12/2017 (“Promotional Period”). All times are AEDST, as applicable in Victoria, Australia.
6. To enter, an eligible individual must visit https://roadshow.com.au/titles/movies/roadshow/2017/tulip-fever, watch the trailer for Tulip Fever, follow the prompts to the entry form, fully complete the entry form, including their first and last name, state/territory of residence, email address and an answer to the promotional question “Why are you excited to see Tulip Fever?” in 25 words or less and submit the entry form so that it is received during the Promotional Period.
7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any entrant who the Promoter has reason to believe has breached any of Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
8. Incomplete or indecipherable entries will be deemed invalid.
9. Only one (1) entry is permitted per person.
10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
11. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on creative merit. The judging will commence on 04/12/2017 at Roadshow Films Pty Ltd, 1 Garden Street, South Yarra VIC 3141.The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant. The winner will be notified by email.
12. The Promoter’s decision is final and no correspondence will be entered into.
13. The best valid entry, as determined by the judges, will win a trip for two (2) people to Sydney valued at up to $2,000, depending on date and point of departure. Prize includes:
Two (2) return economy airfares from winner's nearest capital city to Sydney, NSW (only provided if winner resides outside of NSW). If the winner is from NSW, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash;
Two (2) nights twin share accommodation in Sydney at the Sofitel Wentworth Hotel; and
A private “money can’t buy” before hours tour of Rembrandt and the Dutch golden age at Art Gallery of NSW with a gallery expert; and
Brunch for two people at Chiswick @ the gallery valued at up to $150.
Prize must be taken between 11/01/2018 and 16/02/2018, on the exact date specified to the winner by the Promoter, once the winner is drawn. Prize is subject to booking and flight availability. Spending money, additional meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. The winner and his/her companion are responsible for ensuring that they have valid travel documentation. The winner and his/her companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in agreement with the winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.
14. The next twenty (20) valid entries drawn will each win a double pass to Tulip Fever valued at up to $43. Double passes are subject to terms and conditions of the issuer including those specified on the movie ticket. Tickets must be presented at the box office. Entrants will be entitled to two (2) tickets to one session only of “Tulip Fever”. List of participating cinema is available athttps://www.movietimes.com.au/Movie/Tulip-Fever. Valid even with “No Free Tickets” restriction. Not valid all day Tuesday (or cinema discount days), Saturdays after 5pm or Public Holidays. Not for re-sale. Tickets must be taken as offered and are not exchangeable, transferrable or redeemable for cash. Redemption of the double passes is subject to any terms and conditions of the issuer including those specified on the double passes.
15. The ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. Prizes are valid for redemption while Tulip Fever is screening in cinemas only. The Promoter and organisers/prize suppliers hereby expressly reserve the right to eject any winner (and/or any companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
16. If for any reason a winner does not take or claim a prize (or an element of a prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
17. If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
18. The total prize pool value is up to AU$2,860.
19. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
20. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
21. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
22. Any cost associated with accessing the competition website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
23. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the Sydney Premiere of Power Rangers event is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of or taking of the prize.
25. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to the members of the Promoter’s corporate group (which may include but is not limited to Village Roadshow Limited and its subsidiary companies), third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI and agreeing to the provisions of this clause. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at: https://roadshow.com.au/pages/privacy-policy. The Promoter (and its corporate group to whom entrants PI will be disclosed) will only use and disclose entrant’s PI in accordance with their respective privacy policies and, if applicable, collection statements. The Promoter (and its corporate groups) to whom personal information is disclosed may use this information for future promotional and marketing purposes regarding their products and services in accordance with their respective privacy policies and, if applicable, collection statements, including contacting entrants via any contact details provided by the entrant without further reference or compensation to the entrant, for an indefinite period or until the entrant opts out. The Promoter’s Privacy Policy contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
26. The Promoter may also disclose PI to selected partners, if an entrant consents to such disclosure at the time of entry, who may use the information for their own marketing purposes.
