TERMS & CONDITIONS
Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents aged between 16 and 22 years who have a genuine interest in the military and university study (“Eligible Entrants”). Eligible Entrants aged less than 18 years old, must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. Eligible Entrants must be fit and healthy in order to undertake the strenuous elements of the prize if selected as a winner.
All Defence Force Recruiting employees and ADF members posted into Defence Force Recruiting associated with this promotion, as well as their immediate families, are ineligible to enter, as are the employees and immediate family members of any entity engaged by the Promoter to establish and/or conduct the promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences at 12:01am AEST on 30/06/2017 and ends at 11:59pm AEST on 14/07/2017 (“Promotional Period”).
To enter, Eligible Entrants must, during the Promotional Period, visit www.defencejobs.gov.au/ADFAOpenDay, follow the prompts to the competiiton entry page, input all requested details, read the quotes presented, then answer the question in 50 words or less “Tell us which quote is your favourite and why?”, and submit the fully completed form.
The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct in relation to the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights, at law or otherwise, at any stage of the promotion does not constitute a waiver of those rights. The Promoter's rights to recover damages or other compensation resulting from any such unlawful or improper misconduct are reserved.
Incomplete or indecipherable entries will be deemed invalid.
Only one (1) entry is permitted per Eligible Entrant.
If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
The judging will take place at Progressive PR, 405 Clarendon Street, South Melbourne VIC 3205 commencing from 17/07/2017 until 21/07/2017. This is a game of skill, and chance plays no part in determining the winners. Each entry will be individually judged, based on literary and creative merit of the answer provided to the promotional question. The judges may select additional reserve entries (in addition to the initially selected winning entries), which they determine to be the next best, and record them in order of merit, in case of an invalid entry or ineligible entrant.
The Promoter’s decision is final and no correspondence regarding the merit of that decision will be entered into with any party.
The three (3) best valid entries, as determined by the judges, will each win a trip for the winner and one (1) companion to Canberra, ACT, to attend the ADFA Open Day, valued at up to $3,000 depending on point of departure. Each prize includes:
Return economy airfares for two (2) people to Canberra, ACT (if required);
Return transfers from winner’s residence to departure airport (if required);
Return transfers from airport to accommodation (if required);
Two (2) nights 4-star accommodation at Mercure Canberra including breakfast;
an ADFA merchandise pack (exact contents of the pack will be determined by the Promoter in its absolute discretion); and
A full two (2) day ADFA Open Day experience with an ADFA cadet escort which may include, but is not limited to, the following activities (subject to change due to unavailability, weather conditions or other reasons beyond the Promoter’s control):
Personal tour of ADFA
Helicopter flight
Weapons Training Simulation System shoot
Over water obstacle course
Roulettes aerial display
Enemy view of section attack demonstration
Spending money, meals (other than as mentioned above), insurance, items of a personal nature, in-room charges and any other ancillary costs are not included. Prize must be taken to coincide with the ADFA Open Day experience event, with flights departing on 24/08/2017 and is subject to booking and flight availability.
If any winner is under 18 years of age, their companion must be their parent or legal guardian. Any winner that is over 18 years of age may be accompanied by another person also aged over 18 years. Parents/guardians/companions acknowledge that they may in some instances be required to only observe the winner perform certain elements of the ADFA Open Day experience, and may not be able to participate.
The winners and their companions must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winners may be required to present their credit card at time of accommodation check in. If a winner is from ACT, then the prize does not include airfares or transfers and these components of the prize will not be redeemable for cash.
The next eight (8) best valid entries, as determined by the judges, will each win an ADFA merchandise pack. Exact contents of the pack will be determined by the Promoter in its absolute discretion.
If for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited and will not be redeemable for cash.
If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
Prizes are not transferable or exchangeable and cannot be taken as cash unless otherwise specified.
Each Eligible Entrant warrants that their entry is an original literary work of the Eligible Entrant that does not infringe the rights of any third party. As a condition of entering this promotion, each Eligible Entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable and sub-licensable right to use, broadcast, reproduce, modify, adapt, publish and display their entry for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use or liability.
Furthermore, Eligible Entrants consent to:
conduct, which would constitute an infringement of their moral rights as defined in section 189 of the Copyright Act 1968 (Cth); and
the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any future promotions), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Entrant; or (b) to modify, suspend, terminate or cancel the promotion in its entirety, as appropriate.
Any cost associated with accessing the promotional website is the Eligible Entrant’s responsibility.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 (Cth) or similar consumer protection laws in the various States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the promotion. The exclusions under this clause 24 do not extend to any negligent acts or omissions of the Promoters (including its respective officers, employees and agents).
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for, and excludes all liability for, any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the promotion is cancelled or postponed for reasons beyond the control of the Promoter, (f) any tax liability incurred by a winner or Eligible Entrant or (g) any use of a prize. The exclusions under this clause 25 do not extend to any negligent acts or omissions of the Promoters (including its respective officers, employees and agents).
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers for the purposes of the promotion and/or future promotions. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed by following the prompts at http://www.defencejobs.gov.au/global/copyrightandprivacy.aspx. In addition to any use that may be outlined in the Promoter’s Privacy Policy, if the Eligible Entrant opts in at the time of entry, the Promoter may, for an indefinite period, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant. The Privacy Policy also contains information about how Eligible Entrants may opt-out, access, update or correct their PI, how Eligible Entrants may complain about a breach of the Australian Privacy Principles, or any other applicable law, and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose Eligible Entrant’s PI to any entity outside of Australia.
