The Tour Provider is Nevermind Adventures (ABN 58 986 884 117), 224 Pakington St, Geelong West VIC 3218 (Contact phone number: (03) 498466465)
For the purposes of these Terms and Conditions, Urban Moto Imports includes all related and subsidiary companies, past, present and future officers, agents, representatives, employees and assigns.
All times referred to in this document are references to Melbourne, Victoria time.
All prize values are GST inclusive.
Entry Requirements
Entry is only open to Australian residents who are 18 years or over and hold a full, valid Australian motorcycle licence issued by a state regulatory authority such as VicRoads in Victoria or Roads & Maritime Services in New South Wales. Employees of the Promoter, the Tour Provider, the operator of bikesales.com.au, carsales.com Ltd and their Immediate Family Members and agencies associated with this promotion are ineligible to enter. “Immediate Family Members” means any of the following: spouse, ex-spouse, de-facto, ex-de-facto, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
The promotion commences at 11:00 am (Melbourne time) on Tuesday 14th March 2017 and ends at 11:59 pm (Melbourne time) on Tuesday 16th May 2017 ("the Promotional Period").
For the avoidance of doubt, entrants cannot submit their entries to be eligible to be the winner of the competition after the end of the Promotional Period.
To enter the promotion, participants must visit www.bikesales.com.au (“bikesales”) and follow the prompts to participate in the Royal Enfield Himalayan Odyssey competition during the Promotional Period. All entrants need to submit the following for their entry to be valid;
A written submission of 25 words or less “why you want to ride a Royal Enfield through the Himalayas?”
The accompanying text:
must not display or contain references to nudity, vulgar language or illegal, irresponsible or dangerous activities, intoxication, consumption of alcohol or drugs, dangerous riding,
must comply with any applicable laws, regulations or any advertising code or guidelines,
must not be libellous, defamatory, discriminatory, misleading or deceptive, and
must not contain references to or violate any party's intellectual property.
The text must be the entrant’s own work.
All entrants must submit their Name, Email, Phone Number, DOB and State of residence. Any personal information collected by the Promoter will be used in accordance with its Privacy Policy available at http://royalenfield.com.au/privacy-policy/
Individuals may enter this competition as many times as they choose during the Promotional Period.
Entrants must be available to travel within July and August 2017 to redeem the prize (please note dates are subject to change due to weather or other factors beyond the control of the Promoter).
The overall Royal Enfield Himalayan Odyssey is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged for the purposes of determining an overall winner based on originality and creative merit of the materials submitted by the entrant. The judges’ decision is final and no correspondence will be entered into.
Prizes
The prize for the winner of the Royal Enfield Himalayan Odyssey is as follows:
The winner will be judged by the Promoter at 10:00 am at Wednesday 17th May 2017. The prize includes; a 12 Day, 11 Night Trip for two to India with return international economy flights from any Australian Capital city, rental of 2 bikes (choice of 500cc Royal Enfield Bullet or Himalaya), airport pickups, and transfers, travel insurance (assuming standard PDS of provider), accommodation (twin share), three main meals per day, local guides, support vehicle, mechanical support, first aid and fuel. The trip will be facilitated by the Tour Provider. The total prize values is $12,800. (RRP, Inc. GST).
The winner of the above prize will be notified by phone and in writing using contact details provided in their entry. Their name will be published on http://www.bikesales.com.au and published via the bikesales Facebook page, include any other owned channels to be utilised here as set out in section 4 below.
The winner and their companion must present their full, valid Australian motorcycle licence issued by a state regulatory authority such as VicRoads in Victoria or Roads & Maritime Services in New South Wales to the Promoter in order to be eligible to participate in the prize.
The prize is subject to the terms and conditions of the Tour Provider http://www.nevermindadventure.com/terms-and-conditions.
The Promoter and Tour Provider are not liable for any costs associated with the collection, redemption or utilisation of the prizes, including travel, expenses and related costs for the winner to get to their closest capital city. Any such costs will be at the winner's expense.
The winner of the above prize is responsible for obtaining their own Indian tourist visa and relevant vaccinations.
A prize may not be transferred or substituted except at the Promoter’s discretion and subject to any applicable legislation. The Promoter reserves the right to substitute a prize of equal or greater value due to prize unavailability. Independent financial advice should be sought by any person participating in this promotion.
The Promoter shall not be liable for any costs associated with any prize before or after the delivery.
The Promoter and Tour Provider shall not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking any prize, except for any liability that cannot be excluded by law. The Promoter shall not be responsible for any entries that are not received or are otherwise interfered with due to problems with the internet or telecommunications services. No responsibility will be taken by the Promoter for any incomplete, late, lost or misdirected entries.
Selection of Finalists and Winner
The judges’ decisions will take place at the offices of the Promoter as set out in the table in 4.c below.
The judges' decisions are final and no correspondence will be entered into.

The winner will be notified via email and phone contact on the decision date specified in the above table. The winner and their companion must present their full, valid Australian motorcycle licence issued by a state regulatory authority such as VicRoads in Victoria or Roads & Maritime Services in New South Wales to the Promoter.
The Promoter reserves the right to re-select the winner in the event of any entrant:
being unable to satisfy these competition conditions, or
forfeiting or failing to claim a prize,
within 14 days of the Promoter contacting the winner. The Promoter will conduct any further selection or selections, as required, at the same place as the original judging but on or as soon as practicable after Wednesday 31st May 2017. Any new winner will be notified in writing (via email) and by phone on the re-selection date as well as being published on bikesales on a date as soon as reasonably practicable after the re-selection.
Entries
All entries become the property of the Promoter and will be used in accordance with its Privacy Policy available at http://royalenfield.com.au/privacy-policy/
Where for any reason an entry does not become the property of the Promoter, the entrant will procure at his or her own cost and grant the Promoter a non-exclusive, royalty free, worldwide license (and right to sub-licence) to use their entry for any purpose determined by the Promoter in its discretion including but not limited to publication on any website or on ay social media channel.
By entering the promotion and consenting, and unless otherwise advised, each entrant also agrees to be entered into a database and the Promoter may use the entrants' name, address, telephone number and the winner’s name and address for future promotional, marketing and publicity purposes in any media worldwide, including sending the entrant electronic messages, without notice and without any fee being paid unless otherwise advised by the entrant.
By opting in to either receive communication from The Promoter or interest in test riding a Royal Enfield each entrant also agrees to be entered into a database and the Promoter may use the entrants' name, address and telephone number for future promotional, marketing and publicity purposes in any media worldwide, including sending the entrant electronic messages, without notice and without any fee being paid unless otherwise advised by the entrant. All personal information will be used in accordance with the bikesales’ Privacy Policy and disclosed to Royal Enfield and used in accordance with their Privacy Policy.
The Promoter may require an entrant or prize winner to execute any document necessary to give effect to item 5b.
Warranties
The Promoter does not take any responsibility for any costs associated with entering and/or accessing this competition including and not limited to internet service provider costs.
If for any reason this promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any applicable law) in its sole discretion to cancel the competition or to disqualify any individual who has tampered with the entry process.
Entrants acknowledge that there may be inherent risks in some aspects of the prize and that participation in the prize may involve participating in dangerous activities. By entering this Promotion and/or accepting the prize, entrants accept that risk for themselves and for their companion(s) (if applicable).
In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter and Tour Provider may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions subject to state legislation.
If the Promoter becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently, the Promoter may deem that prize winner ineligible.
Except for any liability that cannot be excluded by law, the Promoter, the Tour Provider and the operator of bikesales, carsales.com Limited (including each of their officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by the winner or an entrant; and/or (f) redemption of the prize; (f) any activity which is part of the Prize.
