Instructions on how to enter, and the prizes, form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entries are only open to persons aged 18 years of age and over.
Employees (and their immediate families) of the Promoters and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences on 17 August 2016 and entries close at 11:59pm AEST on 30 December 2016 (“Promotion Period”).
To enter, individuals must enter their contact details and answer in 25 words or less “why you need a long weekend away in Thredbo” during the Promotion Period on the webpage www.garageentertainment.com.au/the-fourth-phase-competition/
By submitting an entry, entrants acknowledge and warrant to the Promoters that each entry is the original work of the entrant. Each entry must comply with these Terms and Conditions. Entries that contain prohibited or inappropriate content, or that are otherwise in breach of these Terms and Conditions, as determined by the Promoters in their sole discretion, will be deemed invalid, and any entrant that submits such an entry will not be eligible to win. All content submitted as part of an entry is subject to clause 19.
The Promoters reserve the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserve the right, in their sole discretion, to disqualify any individual who the Promoters have reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoters’ discretion. Failure by the Promoters to enforce any of their rights at any stage does not constitute a waiver of those rights. The Promoters’ legal rights to recover damages or other compensation from such an offender are reserved.
Late, incorrectly submitted, incomplete or indecipherable entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoters reserve the right, in their sole discretion, to determine the identity of the entrant.
After the "Promotion Period", one entry will be chosen to win the prize. Each entry will be individually judged by representatives of the Promoters based on the content.
The Promoters’ decision is final and no correspondence will be entered into.
After the "Promotion Period" one valid entry, as determined by the judges, will win a trip for two to Thredbo Resort, valued at AUD $4,500 RRP (see Prize inclusions below), to be notified on Friday 30 December 2016 2016.
For all travel prizes; Passports, any requisite visas, spending money, meals, insurance, transport to and from departure point (being the nearest capital city with international airport), additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. The winner and companion must depart from and return to the same departure point and travel together. Frequent flyer points will not form part of the prize. If for any reason a winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash and is subject to booking and flight availability. Itineraries are to be determined by the Promoter in its absolute discretion.
During the entire duration of the travel prize, The Winner (and his/her companion) is responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. Prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present credit card at time of accommodation check in.
As a condition of accepting the prize, the winner (and his/her companion – where applicable) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
If for any reason a winner cannot be contacted or does not redeem a prize by the time stipulated by the Promoters (7 Days after receipt of notification), then the prize will be forfeited.
If any prize is unavailable, the Promoters, in their sole discretion, reserve the right to substitute the prize with a prize to the equal value and/or specification.
Total prize value is approximately AUD$4,500 RRP. The Prize is not transferable or exchangeable and cannot be taken as cash, credit or product and no exchanges are offered. The Prize includes, for 2 persons only, 3 nights at the Thredbo Alpine Hotel, a 3-day lift pass, 3 days equipment hire, and 2 entries into the 2017 Transfer Bank Slalom. The Prize also includes, for 1 persons only, Quiksilver and DC gear worth $1000.
Any ancillary costs associated with a winner redeeming the prize are not included.
Prize winners are advised that tax implications may arise from their prize winning and may wish to seek independent financial advice prior to the acceptance of the prize.
Redemption and use of the Prize is available for the weekend of the Banked Slalom, 2017.
Entrants agree that they are fully responsible for any materials they submit via the promotion (“Content”). The Promoters shall not be liable in any way for such Content to the full extent permitted by law. The Promoters may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoters may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) their Content shall not contain viruses or cause injury or harm to any person or entity; (c) they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content; (d) the Content is the original work of the entrant; (e) they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1994 and warrant that they have the full authority to grant these rights; and (f) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems. Without limiting any other terms herein, the entrant agrees to indemnify the Promoters for any breach of the above terms.
Entrants consent to the Promoters using their entry, name and likeness in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoters.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoters reserve the right, in their sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the website is the entrant’s responsibility and is dependent on the Internet service provider used.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under consumer protection laws in Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters’ control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use and/or redemption of a prize, including any political, legal, social or economic situations or any sort which may preclude the Winner (or the Winners’ companion) from any aspect of using the redeemed prize.
The Promoters collect personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information, including any further information which may be required (for both the winner and his or her companion for the Prize) in order to provide the prize. The Promoters may use the information for promotional, marketing and publicity purposes, including sending electronic messages. Entrants should direct any request to access, update or correct information to either of the Promoters at the addresses below. All entries become the property of the Promoters.
