Employees (and their immediate families) of the Promoter, Participating Stores (as defined below) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Entries into the promotion open on 11/03/2020 and close at 11:59pm AEST on 14/04/2020 (“Promotional Period”).
To enter individuals must complete the following steps during the Promotional Period:
Spend $25 or more on any Jim Beam product in a single transaction at a Participating Store or online at https://www.liquorland.com.au/ (“Qualifying Transaction”). Individuals must ensure they receive a purchase receipt for the Qualifying Transaction. In the event a purchase receipt is not automatically provided by a member of staff or online, it is the individual’s responsibility to request one; and then
Visit www.jimbeampromotions.com.au/ll-kentucky, follow the prompts to the promotion entry page, input the requested details (including their full name, email address, and telephone number), upload a copy of the purchase receipt for the Qualifying Transaction and submit the fully completed entry form.
A participating store is any Liquorland store in Australia that displays promotional material for the promotion (“Participating Store”).
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete or indecipherable entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Transaction (regardless of the amount spent in excess of $25 on Jim Beam in that transaction); and (b) each entry must be submitted separately and in accordance with entry requirements.
Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase, that $25 or more was spent on Jim Beam and that the purchase was made during the Promotional Period but prior to entry.
The draw will take place at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina NSW 2250 on 15/04/2020 at 1pm AEST in the presence of an independent scrutineer. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winner will be notified in writing within two (2) business days of the draw and their name will be published online at www.jimbeampromotions.com.au/ll-kentucky from 24/04/2020.
The Promoter’s decision is final and no correspondence will be entered into.
The first valid entry drawn will win a trip for four (4) adults aged 21 years or over to Kentucky, USA valued at up to AUD$30,000 (depending on point of departure). Prize must be taken to coincide with 4th of July 2020. Prize includes:
Four (4) x return economy class airfares from winner's nearest Australian capital city to Louisville, Kentucky, USA;
Return transfers between airport and accommodation;
Five (5) nights twin share 5-star accommodation including breakfast daily (on set menu);
Jim Beam Distillery Tour at Jim Beam American Stillhouse;
Transfer between accommodation and Jim Beam American Stillhouse; and then between Jim Beam American Stillhouse and Jim Beam Urban Stillhouse;
Lunch at Fred’s Smokehouse up to the value of AUD$200;
Jim Beam cocktail mixology class at Jim Beam Urban Stillhouse;
Dinner at a restaurant of the Promoter’s choice in Louisville up to the value of AUD$800 (exact restaurant to be determined by the Promoter and communicated to the winner);
4th of July experience including food and beverages (exact location of experience to be determined by the Promoter and communicated to the winner);
Jim Beam merchandise for the winner and his/her companions (exact merchandise awarded to be determined by the Promoter in its discretion);
AUD$1,000 spending money for the winner only awarded via cheque or EFT into an account in the winner’s name;
AUD$90 to be used towards the cost of ESTA visas into the USA for the winner and his/her companions; and
Comprehensive travel insurance for the winner and his/her companions (subject to clause 18 below).
The winner and his/her companions must be aged 21 years or over and hold a valid passport with a minimum expiry date of 12/01/2021 and must meet the eligibility requirements of the ESTA visa for entry into the USA. The winner and his/her companions will be responsible for securing/obtaining their ESTA visa prior to their departure. The winner and his/her companions are responsible for ensuring that they have valid passports, and any requisite visas and travel documentation. Failure to do so may result in the prize being forfeited.
Prize is a single event holiday and cannot be separated into different holiday vacations. The winner and his/her companions must depart from and return to the same departure point and travel together. No compensation or alternative travel plans will be arranged should the winner and/or his/her companions miss their outbound or return flights or fail to meet any check in requirements for any reason. Any such costs will be the responsibility and expense of the winner and/or his/her companions. Once the prize has been booked, changes are not permitted, unless otherwise authorised by the Promoter in its discretion, in which case a fee of $150 (including GST) per person will be incurred for any changes made. All prize suppliers (including the airline) will be chosen at the discretion of the Promoter and/or its prizing agency 33 Degrees Worldwide Pty Ltd. Travel itinerary to be determined by the Promoter and/or its prizing agency 33 Degrees Worldwide Pty Ltd in their absolute discretion. The winner may be required to present their credit card at time of accommodation check in. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner and his/her companions including but not limited to additional meals, additional spending money, incidentals, mini-bar, laundry, room service, telephone calls, taxes (excluding airline and airport taxes) insurance, passports, transport to and from departure point and all other ancillary costs. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers.
Travel insurance is only available for four (4) adults aged between 21 and 58 years of age (inclusive), subject to approval by the Promoter’s nominated travel insurer. In the event that the winner or his/her companions are aged 59 years of age or over, or they have a pre-existing medical condition that they wish to declare in order to have full cover, the winner and/or his/her companion will be responsible for any additional costs incurred outside the included standard travel insurance amount in order to take out a policy, as determined by the Promoter’s nominated travel insurer. If the winner and/or his/her companions declines travel insurance as provided by the Promoter’s nominated travel insurance, the winner and/or his/her companions will be required to complete a travel insurance waiver form acknowledging that they understand the benefits of travel insurance but decline to take out the policy. The winner and his/her companions will each be required to fully complete a travel insurance application form provided by the Promoter and may also be required to undergo medical tests as required by the Promoter’s nominated travel insurer, in order to redeem the travel insurance element of the prize. Any person found guilty of insurance fraud or failure to honestly and accurately disclose all relevant insurance information at the time of applying for a travel insurance policy or when making a claim forfeits any rights or entitlements to the travel insurance element of the prize. Travel insurance will be provided by the Promoter’s nominated travel insurer, and subject to approval by the travel insurer. In the event that the Promoter’s nominated travel insurer refuses to issue insurance to the winner and/or companions, the winner forfeits that travel insurance element of the prize. Travel insurance is subject to the terms and conditions issued by the Promoter’s nominated travel insurer, including but not limited to any limitations on the covered amount.
The winner must claim and accept the prize by 5pm AEST on 20/05/2020. As a condition of accepting the prize, the winner and his/her companions must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release, liability and publicity waiver and indemnity form, and must provide copies of valid passports for all travellers within seven (7) days of the winner accepting the prize. The winner and his/her companions must finalise the prize booking within ten (10) days of the winner accepting the prize.
The winner and his/her companions agree they will not sell or otherwise provide their story and/or photographs to any media or other organisation, apart from the Promoter and the Promoter’s prize agency (33 Degrees Worldwide Pty Ltd).
Elements of the prize are subject to the event venue and venue terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or his/her companions) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
If the prize (or part of the prize) is unavailable the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Subject to the unclaimed prize draw clause, if for any reason the winner does not take / redeem the prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
Total prize pool value is up to AUD$30,000 Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
A draw for the prize if unclaimed may take place on 21/05/2020 at the same time and place as the original draw, in the presence of an independent scrutineer, subject to any directions from a regulatory authority. The winner, if any, will be notified in writing within two (2) business days of the draw and their name will be published online at www.jimbeampromotions.com.au/ll-kentucky from 29/05/2020. The winner of the unclaimed prize draw, if any, must claim and accept the prize by 5pm AEST on 11/06/2020.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
The Promoter makes no representation as to the safety of the destination and it is the responsibility of the winner and his/her companions to check the travel advice issued by the Department of Foreign Affairs and Trade at www.smartraveller.gov.au and assess the safety of the destination country prior to travel.
The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au. Entry and continued participation in this promotion is subject to the licensee’s liquor serving policy.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. The winner and his/her companion agree they will not sell or otherwise provide their story and/or photographs to any media or other organisation.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) if any of the tours or experiences awarded as part of the prize are postponed or cancelled for any reason beyond the reasonable control of the Promoter; or (g) use, taking of or participation in any element of a prize.
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.jimbeam.com/privacy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose personal information to entities outside of Australia (see the Promoter’s Privacy Policy for details).
