Terms and Conditions
By entering The Block competition (“the Competition”), you are agreeing to the following terms and conditions:
1) Information on how to enter forms part of the terms and conditions. Entry into this Competition is deemed acceptance of these terms and conditions of entry.

WHO CAN ENTER?

2) The Competition is open to all residents of Australia who are aged 18 years and over and are available to travel to Melbourne on any given day between Monday 28th November – Friday 2nd December 2016 for one (1) night, as nominated by the Promoter in its absolute discretion, except employees (and their immediate families) of the Promoter, the Sponsor and all companies and agencies associated with this Competition (“Entrants”).
HOW TO ENTER th
3) The Competition commences on Sunday 11 September 2016 at 19:30 AEST and concludes
Friday 18th November 2016 at 23:59 AEDT (“the Competition Period”).
4) In order to be eligible to enter the draw to win the prize in the competition (“Competition”), participants must go online to https://www.9now.com.au/the-block/season- 12/extras/win/competitions/stayz and:
a. follow the prompts to select the apartment of any one (1) of the five (5) couples in which you would like to stay in;
b. follow the prompts to the Competition entry form, input the requested details including their full name, full street address, valid email address and telephone number;
c. agree to the Competition terms and conditions; and
d. submit the fully completed Competition entry form.
5) Multiple entries permitted, subject to the following: one (1) entry (and vote) per person per 24 hour period.
6) If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.
7) All entries are deemed to be received at the time of receipt by the Promoter and NOT at the time of transmission by the Entrant.
8) The Promoter reserves the right to verify the validity of entries at any time during or after the Competition Period, and reserves the right to disqualify any Entrant who tampers with the
entry process (including but not limited to tampering by way of the utilisation of techniques designed to avoid the payment of postage costs) or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9) The Promoter and Sponsor take no responsibility should an entrant not have the software, hardware or internet access or data plan that would permit access to and use of the App or website. The App is free to download. Standard carrier fees will apply to the download and use of the App but there is no additional charge for the App itself. Any cost associated with accessing the internet or downloading data on a device is the entrant’s responsibility and is dependent on the internet service provider used.
10) Subject to state permit authority restrictions, In the event that The Block is cancelled prior to the first Room Reveal, the Competition will be cancelled (subject to relevant regulatory approval). Any entries received after The Block ceases will not be included in the Competition.
PRIZE
11) There will be one (1) Major Prize Winner and they will receive the prize package detailed below. The first valid entry drawn from the total pool of valid entries will win the Major Prize. The draw will take place at Nine Digital Pty Ltd, ABN 33 077 753 461, Level 7, Tower st Building, Australia Square, 264-278 George Street, Sydney, NSW 2000 on Monday, 21 November 2016 at 09:30 AEDT. Winner will be notified by phone and mail and their name will be published on https://www.9now.com.au/the-block/season-12/extras/win on Tuesday, 22nd November 2015.

12) The total prize pool for the Major prize is valued at $25,000.00
13) Prize winner must be available to travel to Melbourne on any date between Monday 28th
November and Friday 2nd December 2016, as determined by the Promoter.
14) The Promoter will confirm which apartment the winner and three (3) companions will stay in at its absolute discretion.
15) The prize winner may redeem the credit onwww.stayz.com.au in accordance with instructions to be provided by Stayz Pty Ltd ABN 41102 711 599 (the Sponsor).
16) The Entrant drawn must confirm their eligibility to be awarded a major prize and ability to take the prize within fifteen (15) hours from the time they are successfully notified by the Promoter that their entry has been drawn. The Promoter may draw ten (10) additional reserve entries in each of the major prize draws and record them (in order) in case an invalid entry or ineligible Entrant is drawn, or an Entrant drawn is unable to take a major prize or fails to confirm their eligibility to accept a major prize within the time required, in which event the major prize will be awarded to the first reserve entry drawn. If the major prize cannot be awarded to the
Entrant drawn, the Promoter will continue this process until the major prize is awarded. If after this process a major prize has still not been awarded, or if an Entrant drawn cannot be notified, the Promoter will hold an unclaimed prize draw in accordance with clause twenty-six (26).
17) The major prize is a single event trip for the winner and two companions (if any) and cannot be separated into separate trips or components. The winner and their companions (if any) must travel together. The return flights for each route must be utilized at the same time, for the same travel dates, to and from the same destination. The air tickets are available on regular scheduled services of airlines and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airline’s departure city and their current flight schedule. All travel is subject to availability at all times. A winner and their companions (if any) are responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed. Travel suppliers/airlines and booking time of flights to be chosen at Promoter’s discretion. Blackout periods may apply. Frequent flyer points are not available from any airline.
18) It is a condition of accepting a major prize that the winner may be requested to present their credit card or a cash deposit upon arrival at any accommodation to cover all incidentals they may incur during their stay.
19) It is the responsibility of the winner and their companions (if any) to ensure they are checked in for their flights and arrive at the airport on the correct date and at the time specified by the relevant airline carrier. The Promoter is not responsible for any costs associated with any winners and/or their companions missing any of their flights.
20) No responsibility will be taken by the Promoter for any delay and/or error in the delivery of the prize, which is outside of the Promoter’s control.
21) All prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable, exchangeable and cannot be redeemed as cash. The prize is not valid in conjunction with any other offer.
22) In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal or greater recommended retail value and/or specification subject to any written directions from the various Lottery Departments.
23) It is a condition of accepting a prize that a winner must comply with all the conditions of use of the prize and the prize supplier’s requirements (as applicable).
24) It is a condition of accepting a prize that a winner agrees to participate in and cooperate with all reasonable media editorial requests of the Promoter and the Sponsor, including but not limited to, being interviewed, photographed and filmed and the Winner grants the Promoter and the Sponsor, respectively, a perpetual, non-exclusive license to use such footage and photographs arranged or taken by them (as applicable) in all media worldwide and the Winner will not be entitled to any fee for such use. The inclusion of any such footage or photographs (including but not limited to creative control of the feature) will remain with the Promoter or Sponsor (as applicable) at all times.
25) Winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
26) As this is an events-based prize, the Promoter may conduct such further draws at the same place as the original draw as are necessary at 0900 AEDT on Wednesday, 23rd November 2016 in order to distribute any remaining prizes that remain unclaimed by that date, subject
however to all reference to any relevant state and territory regulations. The winner(s), if any, of such draw will be notified by telephone and in writing within two (2) business days of the draw and will have their name published on https://www.9now.com.au/the-block/season- 12/extras/win on Thursday, 24th November 2016.
GENERAL
27) The use of any automated entry software or any other mechanical or electronic means that permits the entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
28) The Promoter is not responsible for any incorrect or inaccurate information, either caused by the user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telecommunications, telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
29) If this Competition is not capable of running as planned due to any reason whatsoever, including but not limited to, programming changes, technical failures (either in the administration of the Competition or the broadcast of the television program), unauthorised intervention, fraud or any causes beyond the control of the Promoter which corrupt or affect the conduct, administration, security, fairness or integrity of the Competition, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law and subject to any written directions given by a regulatory authority, to: (a) modify, suspend, terminate or cancel the Competition; and/or (b) disqualify any entrant, as appropriate, including banning an entrant from participating in future promotions conducted by the Promoter, for any reason including, but not limited to, behaving in any manner that is, as determined by the Promoter in its absolute discretion, deemed to be inappropriate or contrary to any broadcast codes, regulations or any applicable laws including mentioning or promoting any product, service, venture or item or using inappropriate language or saying anything that may in the producer's reasonable opinion be abusive, rude, threatening, offensive, harmful or hurtful to any other third party.
30) The Promoter accepts no responsibility for any entries not received by the Promoter or delays due to technical disruptions or for any other reason. An entry will only be counted as being received when it has been received by the Promoter’s software system, not when it was sent from the entrant.
31) The Promoter reserves the right to request each Winner to provide proof of age and identity. Identification considered suitable for verification is at the discretion of the Promoter.
32) If the Promoter determines that the winner has breached clause 5 of these Terms and Conditions, their entry will be deemed invalid and the prize will be forfeited and subject to the unclaimed prize draw in accordance with clause 22 above.
LIABILITY AND RELEASE
33) Except for any liability that cannot be excluded by law, the Promoter and its related entities and their respective officers, employees and agents, exclude all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft,
unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a Winner or Entrant; (f) participation in the Competition and/or (g) redemption of the prize.
34) It is a condition of participation that a winner and their companions will be required to sign legal releases in any form to be determined by the Promoter at its absolute discretion
35) The Promoter and its related entities and their respective officers, employees and agents will take no responsibility for defective prizes or prizes damaged or lost in transit, or late, lost or misdirected mail.
PERSONAL INFORMATION
36) The Promoter will collect entrants’ personal information in connection with this Competition and will use and handle the personal information in accordance with these Terms and Conditions and the Promoter’s Privacy Policy at https://login.nine.com.au/privacy?client_id=9nowweb.
37) Sponsor opt-in: The details of all Entrants who opt-in to hear from the Sponsor will be entered into a database and the Sponsor may use these Entrants’ names, email address, residential addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee. By opting-in, Entrants confirm that they allow their details to be used for this purpose and in accordance with the Sponsor’s privacy policy. Entrants can unsubscribe from receiving email newsletters at https://fairfax- stayz.secure.force.com/SubscriptionCentre/Unsubscribe?email=(enteremail) at any time and for any reason.
