If there is a dispute as to the identity of an entrant, the Promoter reserves theright, in its sole discretion, to determine the identity of the entrant.12. The totalprize value is up to $67,578 which includes on-road costs: 12 monthsregistration, compulsory third party insurance, stamp duty and dealer deliverycharges (which may vary State by State).15. The Promoter and Sponsor take no responsibility for petrol, comprehensiveinsurance, health, transport, body, paint or mechanical damage, or any othercosts or damages, from date of delivery. The winner will be responsible forany expenses incurred in getting to and from their nearest authorisedVolkswagen Dealer as determined by the Sponsor to collect the vehicle within2 months of being notified by the Promoter. In Western Australia (WA),winners will be responsible for arranging and paying for an immobiliser to befitted, as required by WA Road Traffic regulations.16. Any prize vehicle specification change requested by the winner (at their cost)is subject to the Sponsor’s discretion and stock availability at the dealership.17. If the winner is, through any legal incapacity or otherwise, unable to registerthe car in their own name, then the winner may assign the car to anotherperson (who consents to such assignment) with legal capacity for the purposeof registration. The Promoter and Sponsor take no responsibility for any sucharrangements between the winner and the assignee. The winner must providethe Sponsor with certified copies of all required documentation as required bythe Sponsor before the car is awarded. If for any reason any winner does not take the prize (or an element of theprize) by the time stipulated by the Promoter, then the prize (or that elementof the prize) will be forfeited.19. Total prize pool value is up to $67,578. Prize, or any unused portion, is nottransferable or exchangeable and cannot be taken as cash, unless otherwisespecified.320. A draw for the prize, if unclaimed, may take place on 03/02/20 at the sametime and place as the original draw, subject to any directions from a regulatoryauthority. Any cost associated with accessing the promotional website is the entrant’sresponsibility and is dependent on the Internet service provider used. Nothing in these Terms and Conditions limits, excludes or modifies orpurports to limit, exclude or modify the statutory consumer guarantees asprovided under the Competition and Consumer Act, as well as any otherimplied warranties under the ASIC Act or similar consumer protection laws inthe States and Territories of Australia (“Non-Excludable Guarantees”). Exceptfor any liability that cannot by law be excluded, including the Non-ExcludableGuarantees, the Promoter and the Sponsor (including their respective officers,employees and agents) exclude all liability (including negligence), for anypersonal injury; or any loss or damage (including loss of opportunity); whetherdirect, indirect, special or consequential, arising in any way out ofthe promotion.25. Except for any liability that cannot by law be excluded, including the NonExcludable Guarantees, the Promoter and the Sponsor (including theirrespective officers, employees and agents) are not responsible for andexclude all liability (including negligence), for any personal injury; or any lossor damage (including loss of opportunity); whether direct, indirect, special orconsequential, arising in any way out of: (a) any technical difficulties orequipment malfunction (whether or not under the Promoter’s control); (b) anytheft, unauthorised access or third party interference; (c) any entry or prizeclaim that is late, lost, altered, damaged or misdirected (whether or not aftertheir receipt by the Promoter) due to any reason beyond the reasonablecontrol of the Promoter or the Sponsor; (d) any variation in prize value to that 4stated in these Terms and Conditions; (e) any tax liability incurred by a winneror entrant; or (f) use of a prize.26. Entrants' personal information will be collected by the Promoter. Personalinformation will be stored on the Promoter's database.
