These Terms and Conditions apply to the promotion, “Win a Yamaha YZF-R1 Motorcycle” when customers complete the online competition entry form, obtain a new Budget Direct Motorcycle Insurance Policy quote, or purchase a new Budget Direct Motorcycle Insurance Policy. Existing Budget Direct customers who hold a Budget Direct Motorcycle Insurance policy prior to the competition commencing and continue to hold that policy as at the date of the draw will automatically be entered into the competition (see Eligibility and Participation section) (Promotion).

The Promotion commences at 12.00am on Wednesday, 15 September 2021 and ends at 10.00am on Wednesday 12 January 2022 (Promotion Period). All times are in Australia Eastern Standard Time.
Subject to these Terms and Conditions, the Promoter is offering one (1) 2021 Yamaha YZF-R1, Black Total RRP $27,349 (including GST). The prize includes twelve months’ registration (including CTP), Stamp Duty and a twelve (12) month Budget Direct Comprehensive Motorcycle Insurance Policy.
Entry into the Promotion and any offer of Budget Direct Insurance is subject to the Insurer deeming that the risk is acceptable in accordance with its Underwriting Criteria. Before purchasing a policy, consider if the product is right for you by reading the Product Disclosure Statement and Financial Services Guide.
Eligibility and Participation
Customers must meet the following criteria to participate in the Promotion (Eligible Entrant):
be 18 years or over and a permanent resident of Australia, or have resided in Australia continuously for six months or more on a temporary work visa at the time of participating in the Promotion; and
not be an officer or employee of the Promoter, its related entities or agents and service providers directly associated with the conduct of the Promotion, or their immediate family; and
during the Promotion Period:
complete the online competition entry form on the Budget Direct website: www.budgetdirect.com.au/landingpages/win-a-yamaha/entry.html;or
obtain a quote for a new Budget Direct branded Motorcycle Insurance policy (providing either comprehensive, third party property, or third party fire & theft cover) through Budget Direct’s website, or by calling the Budget Direct call centre on 1300 306 560 (Eligible Budget Direct Quote); or
purchase a new Budget Direct branded Motorcycle Insurance policy (providing either comprehensive, third party property, or third party fire & theft cover) through Budget Direct’s website, or by calling the Budget Direct call centre on 1300 306 560 (Eligible Budget Direct Policy); or
hold a Budget Direct Motorcycle Insurance policy prior to the competition commencing and continue to hold that policy as at the Draw Date (Existing Budget Direct Policy); and
provide a valid email address.
An Eligible Budget Direct Policy is only eligible for this Promotion once it has been held by you for 21 consecutive days and remains valid as of the Draw Date. Customers renewing or varying their Existing Budget Direct Policies will be allocated 1 entry in total as an Existing Budget Direct Policy holder.
Eligible Entrants will be awarded a maximum of:
One (1) entry will be awarded for every Existing Budget Direct Policy.
One (1) entry into the Promotion for completing the competition entry form. Additional entries will not be awarded for multiple entry form completions.
Five (5) entries into the Promotion for an Eligible Budget Direct Quote. Additional entries will not be awarded for multiple quotes.
Ten (10) entries into the Promotion per Eligible Budget Direct Policy purchased during the Promotion Period.
Entries will be deemed accepted at the time of receipt by the Promoter, or as determined by the Promoter. Entries received will be considered final by the Promoter.
Any Eligible Entrant who provides incorrect, misleading or fraudulent information, or submits an entry that infringes any rights of any third party, or contravenes any law or is otherwise objectionable will render all entries submitted by that Entrant invalid.
The Promoter may request the Eligible Entrant produce appropriate photo identification and other documentation to confirm, to the Promoter’s satisfaction, the Entrant’s eligibility to enter the Promotion and the validity of their entry, failing which all entries of that Entrant will be deemed invalid.
Draw and Prizes
The prize draw will take place at Suite 2, Level 2, 105 Reservoir Street, Surry Hills NSW 2010 at 10.30am (AEST) on 8 February 2022 (Draw Date).
The total maximum prize pool for the Promotion is $28,349 (inc.GST).
A total of one (1) eligible motorcycle winner will be selected on the Draw Date. The Promotor may request evidence of their validity and eligibility of entry, including but not limited to photo identification or a valid State or Territory driver’s licence (Eligible Motorcycle Winner).
The Eligible Motorcycle Winner will be notified via their nominated email address within two (2) business days of the Draw Date, or by 10 February 2022. The Eligible Motorcycle Winner’s name will be published on the terms and conditions page of the Promoter’s website at www.budgetdirect.com.au following the Draw Date and will remain on the Promoter’s website for no less than twenty-eight (28) days. All reasonable steps will be taken by the Promoter to notify the Eligible Motorcycle Winner.
In case of an invalid entry or the Eligible Entrant is ineligible to accept the prize, or declines to accept the prize (Ineligible Motorcycle Winner), the Promotor may draw five (5) additional reserve entries and record them (in order). In the event of an Ineligible Motorcycle Winner, the prize will be awarded to the first reserve entry drawn. If a prize cannot be awarded to an Eligible Entrant drawn, the Promoter will continue this process until the prize is awarded. If after this process, if a prize has still not been awarded, or if an Eligible Entrant drawn cannot be notified, the Promoter will hold an unclaimed prize draw in accordance with Clause 18.
Unclaimed Prize Draw
A prize will be deemed unclaimed if the Promoter is not reasonably able to contact the Eligible Motorcycle Winner within three (3) months and one (1) day of the Draw Date via the contact details provided at the time of entry.
An Unclaimed Prize Draw will be held in order to distribute any prizes that remain unclaimed, at the location in clause 12, subject to any written directions made under applicable State or Territory Legislation, on 9 May 2022.
Any Unclaimed Prize Draw winner will be notified via their nominated email address, within 2 business days of the Unclaimed Prize Draw or by 11 May 2022. An Unclaimed Prize Draw winner’s name will be published on the terms and conditions page of the Promoter’s website at www.budgetdirect.com.au on 11 May 2022, and will remain on the Promoter’s website for no less than twenty-eight (28) days. All reasonable steps will be taken to notify the winners of the Unclaimed Prize Draw
Redemption/Collection of Prize
The Eligible Motorcycle Winners’ prize, is supplied by the Insurers’ preferred supplier, Motorcycle Holdings Limited ABN 29 150 386 995 (Motorcycle Holdings) and must be collected from a nominated dealership, at the Eligible Motorcycle Winners’ cost. The motorcycle is new, and the exact type and colour of the motorcycle will be determined in the sole and absolute discretion of Motorcycle Holdings at the time of collection, which will depend on availability at the time. Additional expenses, such as petrol and all other ancillary costs are the responsibility of the Eligible Motorcycle Winner.
The Eligible Motorcycle Winner must ensure they hold all required State or Territory licences required to collect and operate the motorcycle. Should the Eligible Motorcycle Winner not be available to collect the Motorcycle from the nominated dealership, the Eligible Motorcycle Winner can seek alternative transport at their own expense.
In the event the Eligible Motorcycle Winner, is unable to register the motorcycle in their own name (included but not limited to licence suspensions or invalid licence), then the Eligible Motorcycle Winner may nominate an alternative person (who must hold a valid Motorcycle licence) to register and transfer the prize to. The Promotor will require signature of a valid agreement to document the agreement to transfer this prize. Following such transfer, the Promoter is not liable for any further prize(s) under this Promotion. Other than provided by this clause 22 and clause 23, the prize or any portion of the prize is not transferable or exchangeable and cannot be taken as cash.
In the event the Insurer deems the Eligible Motorcycle Winner an unacceptable risk in accordance with its insurance underwriting criteria, then the Insurer may refuse to offer or provide insurance for the motorcycle. If the Insurer is unable to offer insurance, the Promotor will pay an equivalent amount for the cost of insurance with an alternative insurance provider for twelve months, up to the value of $1,000.
Privacy Statement and Marketing Consent
The Promoter is committed to protecting your Personal Information and agrees to be bound by the Privacy Act 1988 (Cth). The Promoter’s privacy policy is available on their website at the following link: https://secure.budgetdirect.com.au/branding/resources/BUDD/legal/car/privacy.pdf. Further details of how the Promoter will collect, store, use and disclose Personal Information can also be found there. Eligible Entrants can gain access to, update or correct any of their Personal Information held by the Promoter by contacting the Promoter’s Privacy Officer at privacyquery@autogeneral.com.au.
By entering the Promotion, Eligible Entrants acknowledge that a further primary purpose for collection of the Eligible Entrant’s Personal Information is to contact the Eligible Entrant in the future with information about the Promoter, including special offers, market research or to provide marketing materials via mail, commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future.
The Promoter will never sell an Eligible Entrant’s Personal Information to other companies, however the Promoter may share an Eligible Entrant’s Personal Information with its Australian and overseas related companies, promotional partners, servants, employees, agents and trusted third parties who may contact the Eligible Entrant for their legitimate commercial purposes. By entering the Promotion, Eligible Entrants acknowledge and agree that the Promoter and any applicable third parties may use their Personal Information in the manner set out in this condition.
The Eligible Entrant agrees that, in the event they are an Eligible Motorcycle Winner the Promoter may use their contact details for the purpose of facilitating the conduct of the Promotion and awarding any prize. The Eligible Entrant will participate in all reasonable promotional activities in relation to the Promotion, as requested by the Promoter and its agents. This may include the Eligible Motorcycle Winner’s name, likeness, image and/or voice (including photograph, film and/or recording of the same), in any media worldwide for whatever purpose and without notification, remuneration or compensation, for marketing and or promotional purposes, for an indefinite period.
General
The Promoter, its related entities, their officers and employers will not be liable for any loss or damage, whether direct, indirect or consequential which is suffered or sustained in connection with the Promotion, including through the use or operation of any prize, except to the extent of any liability which cannot be excluded by law (including any applicable consumer guarantee under the Australian Consumer Law).
If the Promotion cannot be conducted as intended for any reason beyond the Promoter’s reasonable control, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or, if necessary, to provide an alternative prize to the same value as an original prize, subject to any written directions made under applicable State or Territory Legislation. The Promotor reserves the right or subject to any written directions from a regulatory authority, to modify, suspend, terminate, withdraw or cancel the Promotion at any time without notice.
The Promotor does not accept any responsibility whatsoever for any tax liability associated, connected with or arising from the Promotion, unless specified within these Terms and Conditions.
In these Terms and Conditions:
"Australian Consumer Law" means Schedule 2 of the Competition and Consumer Act 2010 (Cth). "Personal Information" means, for the purpose of the Privacy Act 1988 (Cth), information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not.
