TERMS AND CONDITIONS
The promoter is PayPal Australia Pty Limited (ABN 93 111 195 389) of Level 24, 1 York Street, Sydney, NSW 2000 (“Promoter”).
This Promotion is based on the following terms and information (“Terms”). Please read these Terms before entering the Promotion. If you participate in the Promotion you will need to accept these Terms in writing before any prize can be awarded. All entry instructions and prize information published by PayPal form part of these Terms.
Promotion commences at 12:01am AEDT on 12 November 2018 and closes at 11:59pm AEDT on 26 November 2018 (“Promotional Period”).
To be eligible, entrants must, during the Promotional Period:
Be 18 years old or over;
Hold an active Australian PayPal account in good standing (i.e. not restricted, or limited);
Have their Australian PayPal account linked to their Uber account;
Complete and pay for three (3) separate trips via the Uber app using PayPal; and
not be employees, contractors (and their immediate families) of the Promoter, the Promoter’s related bodies corporate or any third parties associated with this promotion.

Eligible Entrant must complete and pay for 3 trips via the Uber app using their PayPal account during the Promotional Period to be eligible to be entered in the draw. AUD $20,000 credited to each winner’s Uber account. 2 winners will receive a free year of Uber rides, valued at AUD $20,000 to be credited to their Uber account.

How will winners be selected?The first two Eligible Entrants drawn will receive the Prize, only entrants who qualify at the close date and time of each draw period will be entered in the applicable draw.
The computerised random draw will be conducted at 2.00pm AEDT on the date outlined in the table below, at MDSA, Level 2, 40 Yeo Street, Neutral Bay NSW 2089.

The prize winners will be notified by email within 2 working days of the draw, and all will be published in The Australian newspaper on 7 December 2018.
When will I receive the prize?If you’re a prize winner, the prize will be provided to you in the form of a AUD$20,000 credit paid to your Uber account. This will be done within 30 days of you being notified that you have won.This money cannot be withdrawn, transferred to a different Uber account, or used as cash or a cash equivalent. It can only be used to pay for Uber trips ordered from the winners’ Uber accounts.
What’s the unclaimed prize draw?Subject to any laws, if a prize is not claimed or forfeited for any reason by a winner within 3 months of the draw date, the prize will be awarded to another Eligible Entrant in an unclaimed prize draw/s on 13 March 2019 at the same time and location as the original draw/s. The prize winner/s, if any, will be notified by email within 2 working days of the draw date and will be published in The Australian newspaper on 20 March 2019.
How can I use the prize?The prize money of AUD $20,000 will be credited to each winner’s Uber account. It is the winner’s responsibility to ensure they comply with Uber’s terms and conditions and maintain both their PayPal account and Uber account in good standing.
The use of the prize money is subject to Uber’s standard terms and conditions. PayPal is not liable in the event the prize winner(s) are unable to use the prize money credited to their Uber account.
Other important information
If you’re a prize winner, we may be required to collect and verify information about your identity before you recieve the credit to your Uber account. This is in connection with our obligations under the anti-money laundering and counter terrorism financing laws. We’ll contact you and let you know what information and documents we require. There may be tax implications from winning a prize. Please seek independent financial advice before you accept the Prize.
Entries may be invalid or PayPal may reject entries if PayPal forms the opinion that an entry breaches PayPal’s User Agreement, or is made fraudulently.
If for any reason, the Promotion is not capable of running as planned, including, without limitation, due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of PayPal, which corrupt or affect the administration, security, fairness or integrity or proper conduct of the Promotion, PayPal reserves the right in its sole discretion take any action that may be available, including to cancel, terminate, modify or suspend the Promotion subject to any direction given under the relevant state/territory permit regulations and/or disqualify any individual who tampers with the entry process.
Except for any liability that cannot be excluded by law, PayPal (including its officers, employees, agents and related Bodies Corporate as defined by the Corporations Act 2001 (Cth)) exclude all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to:
any technical difficulties, technical error or equipment malfunction (whether or not under PayPal’s control);
any error, omission, interruption, deletion, delay, defect, theft, unauthorised access or third party interference;
any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by PayPal) due to any reason beyond the reasonable control of PayPal;
any tax liability incurred by a winner or eligible entrant; or
use of a Prize.
Under no circumstances will PayPal’s total aggregate liability in connection with this Promotion, whether based upon warranty, contract, statute, tort (including negligence) or otherwise, exceed AU$1,000.
These rules constitute the entire terms and conditions between the Eligible Entrant and PayPal with respect to the promotion and cannot be altered, modified or amended.
These terms are subject to the applicable State or Territory lottery laws.
All entries become the property of PayPal. If you participate in this Promotion you agree that PayPal other entities on its behalf may use and collect your personal information to administer this promotion and to contact you about this promotion. This information will be collected and used in accordance with PayPal’s Privacy Policy, which can be found by clicking on “Legal Agreements” at the bottom of our website (www.paypal.com.au). Your personal information may be disclosed to third parties including marketing agencies in order to conduct this promotion and to the authorities responsible for the regulation of lotteries. Winners' names will be published and retained as required by relevant legislation.

A ‘free year of Uber Trips’ is based on the calculations of 2 x Uber trips per day, valued at AUD $27 per ride for 365 consecutive days. This comes to a total of AUD $20,000. No additional money will be provided if the prize winner uses up his or her allocated AUD $20,000 before the 365 days are over.
