ALIENWARE AURORA GIVEAWAY – COMPETITION LED BY GFINITY ESPORTS AUSTRALIA
TERMS AND CONDITIONS
The promoter of the “Alienware Aurora Giveaway” (Competition) is Gfinity Esports Australia Pty Ltd of 100 William Street, Sydney NSW (Promoter).
Entry into the Competition constitutes acceptance of these terms and conditions and the Dell Privacy Policy. All entry instructions and prize information published by the Promoter also form part of these terms and conditions. This competition adheres to the guidelines for Facebook contests.
Competition dates
The Competition commences at 6:00 PM (AEST) on Friday, 6th of July 2018 and closes at 10:00 AM (AEST) on Friday, 20th of July (Competition Period).
Eligibility Criteria
Entry into the Competition is free and entries must be completed and received by the Promoter within the Competition Period. The Competition is open to individuals who meet the Eligibility Criteria (Entrants).
To enter the Competition, Entrants must:
be an Australian resident aged 15 years or older;
be or become a user of a valid email account; and
not be a director or employee of the Promoter or Dell Australia, or an immediate family member of a director or employee of the Promoter or Dell Australia.
Entrants aged under 18 years must obtain the consent of their parent or legal guardian to enter the Competition and provide Personal Information about themselves. All entries of Entrants who are under the age of 18 years and enter the Competition without disclosing (or attempting to conceal) their age (as and where required) and/or do not provide the required parental or guardian consent (as and where required) will be deemed invalid. These Terms and conditions will bind the Entrants and any parent or legal guardian who gives their consent (for Entrants aged under 18 years). If a winner is aged under 18 years, the prize will, at the sole discretion of the Promoter, be awarded to the parent or legal guardian who consented to the winner entering the Competition on behalf of the winner and that parent or legal guardian must accompany the Entrant for the duration of the prize.

7. The Promoter takes no responsibility for late, lost or misdirected entries or any delays or failures in any telecommunications services or equipment. Entries will be deemed to be accepted at the time of receipt by the Promoter and not at the time of transmission. Incomplete, inaccurate, erroneous, ineligible or incomprehensive entries will be deemed invalid.
8. Costs associated with accessing any online websites, events or apps in assocation with this competition and the competition post remain an Entrant’s responsibility and may vary depending on the Internet service or telecommunications provider used.
9. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
10. The Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Instagram or Twitch. Entrants understand that they are providing their information to the Promoter and not to Facebook, Twitter, Instagram or Twitch. Entrants are solely responsible and liable for any content or information they transmit to other Internet users. To the extent permitted by law, each Entrant agrees to indemnify, defend and forever hold harmless, Facebook and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an Entrant in respect of the Entrant’s participation in the Competition. Any questions, comments or complaints about the Competition must be directed to the Promoter and not to Facebook, Twitter, Instagram or Twitch.
11. Entrants are required to take full responsibility for the content of their entry and for ensuring their entry complies with these Conditions of Entry, and any Conditions of Entry provided in confidence from the Promoter to the entrant. For the purposes of these content requirements, ‘entry content’ includes any content (including text, photos, videos and email messages) that entrants submit, upload, transmit, publish, communicate or use in connection with their entry into the Competition. Entries must use the entrant’s own voice and approved Promoter footage, creating an original work. The Promoter reserves the right to verify, or to require the entrant to verify that the entry is the entrant’s original work. If any entry cannot be verified to the Promoter’s satisfaction, the entry may be deemed invalid. The Promoter may, in its absolute discretion, edit, modify, delete, remove or take-down any part of an entrant’s entry. An entrant’s entry must not include:
a) Any image or voice of any other person without that person’s express consent. Entrants warrant that if any such content is included, they have obtained the express consent of the relevant person;
b) any content that contravenes any law, infringes the rights of any person or is potentially insulting, inflammatory, defamatory, obscene, offensive, discriminatory, indecent or otherwise objectionable or inappropriate (which includes, without limitation, any content involving nudity, malice, excessive violence or swearing); and
c) any literary, dramatic, musical or artistic work, any audio-visual or sound recording, or any other item in which copyright subsists, unless the entrant is entitled to do so. If an entrant has any doubts about whether they have the right to include any content (for example, recorded music) they must not include it. By including any such content in their entry, the entrant warrants that they have the permission of the relevant copyright owner to do so and that this permission allows the Promoter to use the entry in accordance with these Conditions of Entry.
12. The Promoter reserves the right to disqualify a winner(s) if Promoter becomes aware that the winner(s) and/or the winner(s)’s entry is of a type described in this clause.
13. Any entry that is made on behalf of an entrant by a third party will be invalid, unless the entrant requires the assistance of a third party to enter due to a disability.
14. The Promoter reserves the right to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses.
Judging and prize draw
12. The draw will done at random from all eligible entries at 11:00 AM (AEST) on Friday, 20th of July 2018 at 100 William Street, Sydney, NSW to determine one (1) winner. The Promoter’s decisions are final and no correspondence will be entered into.
13. The winners will be notified by the Promoter (or its agents) by 5:00 PM (AEST) on Friday, 20th of July via the email submitted on entry. The name of the prize winner will be published on the Gfinity Esports Australia Facebook page (https://www.facebook.com/GfinityAU) & Gfinity Esports Australia Twitter page (https://www.twitter.com/GfinityAU). All reasonable steps to notify the winners of the results of the judging will be taken by the Promoter.
In the event that the Promoter cannot successfully contact an Entrant who submitted the best judged entry within two (2) business days of the judging, or in the event of an invalid entry or an ineligible Entrant, or if the Entrant is ineligible to accept or declines to participate in the prize, the Promoter may, in its sole discretion, redraw the winning entry. The Promoter will continue this process until an Entrant has been successfully contacted and the Entrant has confirmed their eligibility to be awarded the prize and ability to participate in the prize. For the avoidance of doubt, only once an Entrant has confirmed their eligibility to be awarded the prize and ability to participate in the prize will the Entrant, subject to these Terms and conditions, be deemed the winner of the judging.
15. The winner must, if requested by the Promoter, verify their compliance with the Competition Terms and conditions prior to receiving a prize. The required verification will be in a form determined by the Promoter in its absolute discretion. If the winner that does not comply with this clause they will be ineligible to receive the prize.
Prizes
The single winner will receive one (1) X Alienware Aurora R7, valued at up to AUD$2,499.00.
The decision by the Promoter to accept or reject an entry is in the Promoter’s sole discretion and no correspondence will be entered into. Any entry that contains content that the Promoter, in its sole discretion, considers to be offensive, obscene, crude or inappropriate in any way or that the Promoter considers may infringe any Intellectual Property Rights or other rights of any person, corporation or entity will not be accepted as an eligible entry into the Competition. This includes but is not limited to any entry which the Promoter considers to be disparaging of any of its or any prize supplier’s products and/or services or is otherwise not in keeping with the spirit of the Competition.
All additional costs not expressly stated, but which may be incurred in acceptance and use of the prize, are the responsibility of the winner.
19. If for any reason any element of a prize becomes unavailable for any reason beyond the Promoter’s reasonable control, then a similar prize of equal or greater value will be awarded to the winning Entrant in lieu.
It is a condition of accepting and participating in a prize that the winner may be required to sign eligibility form(s), code(s) of conduct and/or legal release(s) (including prize acceptance release(s)) in a form determined by the Promoter in its absolute discretion. If a winner is under 18 years of age, their parent or legal guardian must also agree to and sign such documents (if requested by the Promoter).
The total maximum prize pool value is AUD$2,499.00. The prize is not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated). The prize must be taken as offered and cannot be varied. The prize cannot be used or redeemed in conjunction with any other offer. The Promoter accepts no responsibility for any tax implications that may arise from prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value. All prize values are the recommended retail price including GST.
Promotional and other obligations
By entering the Competition, Entrants agree that, in the event that their entry is selected as a winning entry, they will be available for reasonable publicity purposes related to the Competition and that (without limiting its rights), the Promoter may conduct interviews and take photographs to be used for such publicity purposes and publication by the Promoter and sign any additional documents reasonably required by the Promoter to give effect to this condition.
Miscellaneous
Entrants can only enter from their own social media and email account. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the Competition and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Entrant’s identity, age, residential address, eligibility to enter and claim a prize, and any information submitted by the Entrant in entering the Competition, before issuing a prize (including confirming consent of an Entrant’s parent or legal guardian and the name, age and address of the parent or legal guardian who gave their consent, where an Entrant is under 18 years of age). If any documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter’s (or its nominated agent’s) satisfaction, then all the entries of that Entrant may be ineligible and deemed invalid.
The Promoter reserves the right to verify the validity of any and all entries and to disqualify any Entrant for: (a) tampering with the entry process; (b) submitting an entry which is not in accordance with these Terms and conditions; or (c) engaging in any unlawful or other improper is conduct calculated to jeopardize the fair and proper conduct of the Competition. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
25. An entry must be the original work of the Entrant, may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity.
26. The Promoter will not be liable for any loss or damage whatsoever which is suffered by an Entrant (including, without limitation, indirect or consequential loss), or for personal injury suffered or sustained, as a result of an Entrant taking part in the Competition, or winning or using any of the prizes, except for any liability which cannot be excluded by law.
27. All entries and any copyright subsisting in an entry become the property of the Promoter. By taking part in the Competition, an Entrant irrevocably assigns all rights, title and interest in their entry to the Promoter and waives any moral rights in relation to the same. An Entrant must procure all individual assignments and moral rights waivers as necessary to ensure the assignment of all rights to the Promoter in accordance with this clause.
28. If for any reason the Competition is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, prohibition by the relevant authorities or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Competition as it sees fit. Any entry which is made as a result of tampering with the entry process will be invalid and not eligible for judging and/or any prizes.
29. The Promoter collects Personal Information about an Entrant to include the Entrant in the Competition and award the prizes. If the Personal Information requested is not provided, the Entrant cannot participate in the Competition and is deemed ineligible.
30. An Entrant also agrees that the Promoter may, in the event the Entrant is a winner, publish or cause to be published the Entrant winner’s name and locality in any media.
31. Entrants can gain access to, update or correct any of their Personal Information held by the Promoter by contacting the Promoter’s Privacy Officer at sgrooby.au@gfinity.net. All Personal Information will be stored by the Promoter in accordance with the Promoter’s Privacy Policy. A copy of the Privacy Policy in relation to the treatment of Personal Information collected in this competition may be obtained at http://www.dell.com/learn/au/en/aucorp1/policies-privacy.
32. In these Terms and conditions: “Intellectual Property Rights” means all present and future rights of whatever nature anywhere in the world including, but not limited to, rights in respect of or in connection with copyright, inventions (including patents), trade marks, service marks, trade names, domain names, designs, confidential information, trade secrets and know-how and similar industrial, commercial and intellectual property rights, whether or not registered or registrable, and includes the right to apply for the registration of such rights, and whether existing in Australia. “Personal Information” means in Australia, for the purpose of the Privacy Act 1988 (Cth), information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not.
33. These Competition terms and conditions are to be construed in accordance with the law in New South Wales and the parties submit to the exclusive jurisdiction of the courts of New South Wales.
