Conditions of Entry:

• Information on how to enter and prizes form part of these conditions of entry.


• The Promotion commences at 9am AEST on Monday 8th October 2018 and closes at 11am AEST on Friday 16th November 2018 ("Promotion Period"). The Promoter is Luxottica South Pacific Holdings Pty Limited (ABN: 58 104 629 772) ("Oakley" or "Promoter"), 75 Talavera Road, Macquarie Park NSW 2113, Australia


• Entry is open to residents of Australian States and Territories over the age of 18 years. Employees of the Promoter, agencies associated with this Promotion and their immediate families are ineligible to enter. The Promoter reserves the right to verify the eligibility of entrants. The Promoter may require such information as it considers reasonably necessary for this purpose and a prize may be withheld unless and until the Promoter is satisfied with the verification.


• To enter the Promotion individuals must, during the Promotional Period, undertake the following steps:

• Only one (1) entry per person will be permitted.


• The Promoter will allow an additional ten (10) entries per person where that person completes an online survey of the Promoter.


• One (1) winner will be drawn by the Promoter and will win the following prize:

(a) Double pass to the Oakley Beach Club (RACV Royal Pines Resort, Gold Coast) including complimentary food and beverage (winner’s companion must be 18 years or over) for use on (RACV Royal Pines Resort, Gold Coast) – valued at up to $400;
(b) Oakley Prize Pack containing Oakley eyewear and Oakley Apparel (including Oakley golf polo, Oakley golf pants, Oakley belt and Oakley Golf Bag – valued at up to $750;
(c) Two (2) nights accommodation at the RACV Royal Pines Resort, Gold Coast, Queensland (as provided by the Promoter on a twin share basis) for 30 November to 2 December 2018 – valued at up to $450; and
(d) Return economy domestic flights to Gold Coast for the winner and his/her travel companion from the capital city in Australia where the winner ordinarily resides – valued at up to $1,200.
No spending money, travel costs, travel insurance or additional entertainment will be provided.
The following additional conditions apply to each prize winner:
(a) travel must be taken as directed by the Promoter and is likely to occur during or around 30 November to 2 December 2018. Entrants must be prepared to travel during the Promoter’s nominated dates;
(b) selection of airline(s), accommodation, entertainment and departure time(s) will be at the Promoter’s discretion;
(c) the prize is non-transferable and cannot be exchanged, delayed or redeemed for cash;
(d) if the winner does not take the prize during the time period stipulated, then the prize is forfeited and cash will not be awarded in lieu of the prize;
(e) any unused portion of the prize is non-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash;
(f) once travel is booked, any changes made to the booking may incur cancellation fees or amendment fees, at the cost of the winner;
(g) the winner will not accrue any frequent flyer points;
(h) all components of the prize must be taken together;
(i) travel insurance is not included in the prize;
(j) all ancillary and travel costs not mentioned in the prize description above are the winner’s responsibility;
(k) all additional costs incurred whereby the prize winner wishes to make variations to the travel are the winner’s responsibility and must be booked separately by the winner;
(l) the winner will be required to behave responsibly including the responsible consumption of alcohol, no prohibited drugs or medication, no aggressive or offensive behaviour, or behaviour which may diminish the enjoyment of the trip by other winner(s) or behavior that may diminish the good name or reputation of the Promoter; and
(m) the winner must as a condition of accepting the prize sign the Promoter’s:
(i)deed of release in relation to the use of his/her name and image for promotional purposes; and
(ii)deed of indemnity and exclusion of liability.

• No alternative prize or cash alternatives will be offered and the dates are fixed in line with the Australian PGA Championship Gold Coast on Thursday 29th November 2018 so cannot be changed.


• The selection of the winner will be run by the Promoter at the address 75 Talavera Road, Macquarie Park NSW 2113, Australia on Monday 19th November 2018 at 12pm AEST. The winner will be contacted by email by a representative of the Promoter on the same day as the draw.

If the prize is not claimed by 10am Wednesday 21st November 2018, a reselection will be run by the Promoter at the address 75 Talavera Road, Macquarie Park NSW 2113, Australia on Wednesday 21st November 2018 at 12pm AEST. The winner will be contacted by email by a representative of the Promoter on the same day as the second draw.

• Winner will be published on the Oakley Australia Facebook page on 19 November 2018.


• Unclaimed prize winner, if required, will be published on the Oakley Australia Facebook page on 21 November 2018.


• If any prize is declined, or the winner cannot be contacted within a reasonable time, reserve winners may be selected at the Promoter's sole discretion in a manner consistent with these terms and conditions.


• The instructions provided at the point of entry form part of the terms and conditions of this Promotion. In the event of a conflict, these terms and conditions take precedence.


• Additional spending money, meals, taxes, insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.


• Prize must be taken to coincide with the event dates chosen with flights departing on Friday 30th November 2018 and returning Sunday 2nd December 2018 and is subject to booking and flight availability.


• Use of the tickets is subject to the terms and conditions on the tickets and the regulations in force at the applicable venue. The tickets may not be resold under any circumstances.


• It is a condition of accepting the prize that the winner may be requested to present their credit card or a cash deposit upon arrival at any accommodation to cover all incidentals they may incur during their stay.


• Flights must be utilized at the same time, for the same travel dates, to and from the same destination.


• Total prize pool is valued up to A$2,800


• The prize is not transferable or exchangeable for cash or any other goods or services. If in the event that the prize is not available, for reasons beyond the control of the Promoter, a prize of similar theme and equal or greater value will be provided.


• The Promoter may, in its sole discretion, disqualify entries deemed to be non-compliant with these terms and conditions and the Promoter reserves the right to refuse entry to or disqualify any entrant whose conduct may be unlawful or otherwise bring the Promotion into disrepute. In the event of such disqualification the Promoter may award the applicable prize to another entrant.


• The decision of the Promoter regarding any aspect of the Promotion is final and binding and no correspondence will be entered into.


• Entry into the Promotion is deemed to be acceptance of these terms and conditions.


• All entries become the property of the Promoter. All entries will be entered into a database and by entering into the Promotion, entrants consent to the Promoter using the entrants' names and addresses to administer the Promotion and for future promotional, marketing and publicity purposes, unless otherwise advised. The Winner agrees that the Promoter may use the name, address and photograph of the winner for promotional, marketing or publicity purposes, unless otherwise advised.

• A Winner may be liable to declare his/her/ prize for taxation purpose and is responsible for payment of any tax, if any.

• The Promoter and Co-ordinator, their related bodies corporate, their officers, employees and agents shall not be liable for and shall be held harmless from any loss, damage, or injury whatsoever which is suffered (including but not limited to direct or consequential loss) or sustained, as a result of or arising from the winner and companion's acceptance and use of the prize, except for any liability which cannot be excluded by law.

All references to dollar amounts are inclusive of goods and services tax (GST).


• In these terms and conditions “related body corporate” has the meaning given in the Corporations Act 2001 (Cth) from time to time and “related bodies corporate” has a corresponding meaning.


• The Promotion is governed exclusively by the laws of Australia.


• Any costs associated with entering the Promotion, redeeming a prize and/or using a prize are the responsibility of the entrant.


• In order to participate in this Promotion and/or the activities which may be awarded as part of the prize, the winner must comply with applicable height, weight, health, fitness, skill, balance, dexterity and any other requirements normally associated with the particular activity. • Entrants acknowledge that there may be inherent risks in some aspects of the Promotion, including without limitation the prize and that participation in the Promotion and/or using the prize may involve participating in dangerous activities. By entering this Promotion and/or accepting the prize, entrants accept that risk.


• If requested by the Promoter, a winner (and any travel companion) must sign an indemnity and exclusion of liability deed (provided by the Promoter) in favour of all parties involved in this Promotion and/or providing the prize. If a winner does not sign the indemnity form provided by the Promoter within the time requested by the Promoter, the winner’s entry or claim will be deemed invalid. Where a winner’s entry or claim is deemed invalid, the Promoter reserves the right to determine a new winner in accordance with these terms and conditions.
