The Promoter's Details
The promoter is Distillery Est Pty Limited ACN 164 606 035 acting in its capacity as trustee for the Distillery Operation Trust ABN 14 396 500 693 trading as Archie Rose Distilling Co. of 61 Mentmore Avenue, Rosebery in the State of New South Wales (Promoter).
Conditions of Entry
The entry to the "Archie Rose Win A Summer Gin Adventure" (the Competition) is free and open to residents of Australia over the age of 18 years (Eligible Person).
The following persons are not eligible to participate in the Competition:
(a) all directors, officers, management, employees and other staff of the Promoter or any venue associated with the promotion and the related bodies corporate of the Promoter or any venue associated with the promotion; and
(b) the immediate family members of directors, officers, management, employees and other staff of the Promoter or any venue associated with the promotion or the related bodies corporate of the Promoter or any venue associated with the promotion (including spouses, children, parents, brothers and sisters).
Participation in the Competition is deemed acceptance of these terms and conditions.
The Promoter may withdraw the Competition at any time, or amend these terms and conditions in its sole and absolute discretion without any further notice to an Eligible Person or an entrant.
How to Enter
To enter the Competition, Eligible Persons must between 9.00 am (AEST) on Monday, 15 October 2018 and 11.59 pm (AEST) on Sunday 25 November 2018 (Competition Period):
(a) visit https://archierosecomp.com.au/ (Archie Rose Promotional Website) and:
(i) choose a preferred Prize; and
(ii) provide the personal details of the relevant Eligible Person; and
(iii) upload a photo in response to the following question:
"What image best describes your favourite Bush or Coast location in Australia?".
Each Eligible Person may only submit a maximum of two (2) entries in the Competition by submitting:
(a) a maximum of one (1) entry for a Bush Prize; and
(b) a maximum of one (1) entry for a Coast Prize.
The Promoter does not guarantee the availability of any one or more of the Prizes. The provision of any Prize is subject to availability and the terms and conditions of any third party providers (as the case may be).
The provision of any Prize is subject to the sole discretion of the Promoter. The Promoter has no obligation to provide any Prize to any person, entrant or Eligible Person whatsoever.
Details of Prizes
There will be a maximum of ten (10) winners of the Competition.
Each winner of the Competition will receive one (1) of the following prizes (Prizes and each a Prize):

Each of the Prizes do not include provision for:
(a) any flights, transportation or transfers; or
(b) any travel insurance.
Each of the Prizes are non-transferable, non-refundable and non-redeemable for cash.
Each Prize can only be used once by the winner of that Prize.
In respect of the accommodation included in each of the Prizes set out in clause 11 above (Accommodation), the relevant winner of each Prize must book that Accommodation directly with the relevant venue and use the Accommodation during the available time periods as set out in the table below (subject to room availability and the terms and conditions of each respective venue):

The Pole House, VIC (see clause 11(i) including dates between 26th November 2018 to 11th October 2019, excluding peak seasons (Dec 23rd – Jan 28th ) Easter, long weekends and subject to availability.
Bannisters, NSW (see clause 11(j) from Sun - Thurs only between the dates of March 1st 2019 to 30th June 2019, excluding NSW school or public holidays and subject to availability.
Duration of the Competition
The Competition will operate for the Competition Period.
Determination of winner
The winner of the Competition will be determined by Friday, 7 December 2018.
The winners of the Competition will be determined by Archie Rose Head of Marketing, Victoria Tulloch, according to the merits and creativity of the photos submitted in the Competition. This decision will be final and cannot be appealed.
Notification of Winner
The winners of the Competition will be notified by email by 5 pm (AEST) on Friday, 7 December 2018.
The names of the winners of the Competition will be posted on the Archie Rose Promotional Page by 5 pm (AEST) from Monday 10 December 2018.
The details of the Prize will be emailed to the address of the winners as nominated in the entry of the winner in the Competition.
Prize Redemption
In order to redeem a Prize:
(a) the winner must:
(i) contact the Promoter at the following email address info@archierose.com.au; and
(ii) provide the Promoter with the nominated Australian address of the winner in order for the Promoter to deliver the Archie Rose Summer Gin in a single shipment to the winner, by 5pm AEST on 18 December 2018; and
(b) the Promoter must confirm by email to the winner:
(i) that the winner has successfully redeemed their Prize; and
(ii) the details of the Prize of the winner.
Once the winner has redeemed their Prize from the Promoter, the winner can then contact the relevant Accommodation venue directly to make a booking before the applicable Relevant Period expires (see clause 15 above).
If the winner does not, for any reason:
(a) book their Accommodation with the relevant venue before the applicable Relevant Period expires (see clause 15 above);
(b) use their booked Accommodation; or
(c) provide the Promoter with a valid nominated Australian address for the Promoter to deliver the Archie Rose Summer Gin to the winner;
the winner will forfeit the Prize and the winner will not be able to use or claim the Prize.
Perpetual Licence
By entering into this Competition, each Eligible Person grants to the Promoter an irrevocable, exclusive, transferrable, royalty-free and perpetual licence (with a right to sub-licence) (Licence) to use and publish in any medium and in any way whatsoever (including for commercialisation) all materials submitted by that Eligible Person to the Promoter as part of the Competition, including any photos (Materials).
Warranties and Representations
By entering into this Competition, each Eligible Person represents and warrants to the Promoter that:
(a) the Eligible Person owns all intellectual property rights in the Materials or otherwise has a right to use and sub-licence the use of the Materials, including to the Promoter;
(b) the Eligible Person has full legal right, power and authority to:
(i) grant the rights and privileges granted by that Eligible Person to the Promoter under these terms and conditions; and
(ii) perform all of the obligations of that winner under these terms and conditions.
Indemnity
By entering into this Competition, each Eligible Person:
(a) unconditionally and irrevocably indemnifies the Promoter against any liability, loss, cost or expense incurred or suffered by the Promoter, caused or contributed to by any breach (actual or anticipated) of these terms and conditions; and
(b) will defend, at its own expense, any action against the Promoter brought by a third party to the extent that the action is based upon a claim that the Materials submitted by that Eligible Person infringes the intellectual property rights or any other rights of a third party;
(c) will defend any such claim at its sole cost and expense and pay those costs and damages finally awarded against the Promoter in any such action that are attributable to such claim or those costs and damages agreed to be paid in any monetary settlement of such action.
Disqualification
The Promoter reserves the right to verify, reject and/or disqualify any entries into the Competition (including after the winner has been determined and notified), including in circumstances where:
(a) the Promoter considers an entry to be offensive, defamatory, objectionable, inappropriate or otherwise infringe the rights of any third party; or
(b) an Eligible Person does not have the full legal right, power and authority to grant the Licence to the Promoter in accordance with clause 25 above;
(c) an Eligible Person or a winner is unable or refuses to take part in any part of the Competition; or
(d) the entry does not comply with any of these terms and conditions; or
(e) the entry is submitted by any person who tampers with or benefits from any tampering with the entry process, the operation of the Competition or who acts in breach of these terms and conditions or who annoys, abuses, threatens or harasses any other person.
No Liability
To the extent permitted by law, the Promoter is not responsible or liable for:
(a) inaccurate or incorrect transcription of entry information;
(b) purported entries that are not received for any reason, including because they are lost, misdirected or stolen, or that are received, but are late, illegible, incomplete, or entered other than as directed in the entry instructions;
(c) any problems or technical failures of any kind, including malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software; (d) unauthorised human intervention in any part of this Competition;
(e) electronic or human error which may occur in the administration of this Competition;
(f) any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a winner and, where applicable, to any family or other persons accompanying a winner; or
(g) any injury or damage to persons or property, including to the computer of the participant or any other person related to, or resulting from, participation or downloading any materials in this Competition.
The Promoter and the related bodies corporate of the Promoter will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from negligence) in connection with this Competition or acceptance or use of the Prize except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
Unclaimed Prize Draw
If a Prize is not redeemed by a winner on or before 4 January 2019, the relevant entry of the winner entry will be deemed invalid and the Promoter will determine another winner in accordance with clause 18 by 5pm (AEST) on 11 January 2019 at the offices of the Promoter and the relevant winner will be notified by telephone and email.
Privacy
The Promoter is bound by the Privacy Act 1988 (Cth) (Privacy Act). The privacy policy of the Promoter explains how the Promoter manages and protects personal information of individual entrants and forms part of these terms and conditions.
The Promoter will handle any personal information that the Promoter collects about an entrant in accordance with the Privacy Act (below) and our privacy policy.
Competition Activities
Entrants (including all Eligible Persons) must, at the request of the Promoter, participate in all promotional activity (such as publicity and photography) surrounding the Competition or the winning of a Prize, free of charge, and they consent to the Promoter and the related bodies corporate of the Promoter using their name and image in promotional material. Without limitation, all entrants (including all Eligible Persons) consent to being broadcast, filmed, photographed or otherwise recorded without compensation while participating in this Competition or in taking or using any Prize, and they consent to the Promoter repeating any such broadcast, film or other recording at any time.
Permit
The conduct of the Competition does not require a permit.
