CONDITIONS
This “M&M’S Makes Holidays” competition (“Competition”) is conducted by Mars Australia Pty Ltd trading as Mars Chocolate Australia, ABN 48 008 454 313, of Ring Road, Wendouree VIC 3355 (“Promoter”).
Entry to the Competition constitutes acceptance of these conditions.
The Competition is only open to Eligible Entrants. An "Eligible Entrant" is an individual who: (i) is a resident of Australia aged 13 years or older as at the time of entry; and (ii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Competition; (iii) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee and (iv) is a shopper of Woolworths Australia Supermarkets. An Eligible Entrant who is under 18 years of age, must obtain the permission of a parent or guardian to enter.
A Qualifying Purchase must be made between 9am on 26/07/17 and 5pm on 29/08/17 (“Promotional Period”). Eligible Entrants may submit their entries between 9am on 26/07/17 and 5pm 29/08/17 (“Entry Period”).
Unless otherwise indicated, all times and dates are times and dates in Sydney which may be AEST or AEDT depending on the date. Where times are stated using the 24 hour clock, 00:00 hrs is the start of a day and 24:00 hrs is the end of a day.
ENTRY
In this Competition, a "Promotion Product" is any M&M'S Minis Tube 35g, M&M'S Milk 180g, M&M'S Peanut 180g, M&M'S Crispy 145g, M&M'S Minis 145g, M&M'S Raspberry 180g, M&M'S Crispy Mint 145g, M&M'S Milk 345g, M&M'S Peanut 345g, M&M'S Crispy 305g, M&M'S Mix Ups 305g, M&M'S Funsize 162g, M&M'S Milk Block 160g, M&M'S Crispy Block 150g, M&M’S Neapolitan 160g, M&M'S Hazelnut Block 155g, M&M'S Crispy Mint Block 150g, M&M'S Peanut Gift Box 440g.
To enter, an Eligible Entrant must first purchase two Promotion Products from any Woolworths Supermarket retail outlet anywhere in Australia or online (www.woolworths.com.au) in the same (one) transaction during the Promotional Period (“Qualifying Purchase”).
Subject to the other conditions, an Eligible Entrant may enter the Competition once for every Qualifying Purchase that they make during the Entry Period. IMPORTANT: If more than two Qualifying Products are purchased in the same transaction, there is still only ONE Qualifying Purchase. Accordingly, only ONE entry may be submitted based on that Qualifying Purchase transaction.
Entry can only be made by internet. Eligible Entrants are able to enter the Competition once per day for the duration of the promotion, subject to each entry relating to a separate Qualifying Purchase.
All entrants must ensure that their entries are received by the Promoter during the Entry Period. The Promoter takes no responsibility for, and will not compensate any entrant for, any late or misdirected entry or for any delays or failures in any telecommunications service or equipment.
For each and every two Promotion Products that an entrant uses to submit an entry, he/she MUST retain: (i) the receipt that was issued (or a photocopy of it) from the purchase of the two Promotion Products that lists the Promotion Products as an item purchased. The two promotion products must be purchased in the same one transaction.
All entries to the Competition may be subject to verification by the Promoter. The Promoter may in its sole discretion, reimburse an entrant for any reasonable costs incurred in complying with this condition.
(i) An entrant MUST, within 7 days of being asked, deliver to the Promoter (by a means reasonably determined by the Promoter) all of the items which condition 11 requires the entrant to retain and which are requested by the Promoter. The Promoter may elect not to return those items.
(ii) An entrant MUST also deliver to the Promoter (by a means reasonably determined by the Promoter) copies of any other documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so.
The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Competition to the Promoter's reasonable satisfaction; or (ii) fails to produce items as required by conditions 11 or 12 or produces items that, in the Promoter's reasonable opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's reasonable opinion, tampers with the entry process or benefits from such tampering; or (iv) in the Promoter's reasonable opinion, submits an entry which is incomplete, inaccurate, erroneous, ineligible, offensive, misleading, inappropriate or incomprehensible, or otherwise is not in accordance with these conditions.
An entry by more than one person (i.e. a joint entry) is invalid.
COMPETITION ENTRY
To submit an internet entry an entrant must use a compatible browser to visit www.m-ms.com.au ("Competition Website") and follow the directions there. For each entry, the entrant must provide:
(i) the last 6 digits of the barcode on the pack of each of the two Promotion Products being used to enter; and
(ii) the receipt number of their Woolworths transaction; and
(iii) all other details required at the Competition Website, including the entrant’s first and last names, postal address, contact telephone number and e-mail address.
Any costs associated with accessing the Competition Website are the responsibility of the person seeking access and are dependent on the internet service provider used.
Eligible Entrants must make their internet entries manually using an internet browser. The Promoter may reject internet entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a competition entry service.
MAJOR PRIZE DRAW AND PRIZE
A random electronic prize draw will be conducted at 12 noon AEST on 31/08/17 at Prime Focus, 500 Chapel Street South Yarra VIC 3141 (“Draw Location”) from all valid entries received during the Entry Period (“Prize Draw”). The first (1) Eligible Entrant with a valid entry drawn in the Prize Draw will win an M&M’S FAMILY HOLIDAY (“Major Prize”) as detailed in paragraph 19.
The Major Prize is an M&M’S AROUND THE WORLD HOLIDAY. The Major Prize, which is specifically subject to conditions in paragraphs 19 to 28, is valued at a maximum of $31,000 (including GST), and includes flights and accommodation for the winner and 3 guests of his or her choice, specifically the prize allows for the following:
i. Economy flights for 4 adults from the winner’s nearest Australian Capital City, travelling to New York (USA), then to London (England), then to Shanghai (China) and finally returning to the winner’s nearest Australian Capital City;
ii. 5 nights in Double Room accommodation in a 4 Star Hotel in New York;
iii. 5 nights in Double Room accommodation in a 4 Star Hotel in London;
iv. 5 nights in Double Room accommodation in a 4 Star Hotel in Shanghai;
v. Airport transfers in each city up to AU$300;
vi. AU$1,000 spending money (provided to the winner only and not his/her accompanying guest(s)); and
vii. Entry to M&M’s World in each visited city.
For the purposes of condition 19 the Major Cities are: Sydney, Canberra, Melbourne, Hobart, Adelaide, Perth, Darwin, Brisbane.
The winner of the Major Prize must give the Promoter at least 120 days’ notice of proposed commencement of travel which must be booked through HRG Australia or their agents. Redeeming the prize is conditional on acceptance of the terms and conditions of travel as detailed by HRG Australia and the airline carriers in accordance with normal travel practices. Itinerary and destinations may be altered at the reasonable discretion of the prize organizer. Travel is valid until 04 November 2018 and no travel can be booked to take place during the following periods: 1 December 2017 to 31 January 2018 or during any Australian public holiday periods. Any spending money will be awarded in the form determined by the Promoter (e.g. via cheque, EFT, etc.). The Promoter may require that the winner and the winner’s guests purchase travel insurance at their own expense. Any required visas are the responsibility of the travelers and may result in additional expenses.
The Major Prize is subject to the airlines’ conditions of travel and availability at all times and maybe dependent on seat class with airlines or specific room category availability with accommodation partner. If any component of the Major Prize is unavailable on the dates proposed by the winner then, subject to condition 21 the Promoter will consult with the winner and endeavour to arrange alternative dates on which the Major Prize will be booked.
Subject to condition 26 all aspects of the Major Prize (including travel and accommodation) are for the winner and their three guests travelling together. The winner, and the winner’s guests, of the Major Prize must travel with the understanding that:
(i) the Promoter may require the guests to confirm in writing that they agree to comply with the provisions of these conditions relating to guests (see condition 41);
(ii) if the winner and their guests want to purchase travel insurance it must be purchased at their own expense; and
(iii) if a person aged less than 18 years wins the Major Prize, he/she must bring a parent or guardian as one of their accompanying guest.
Once tickets have been arranged by the Promoter, changes to the travel or accommodation arrangements are subject to availability and are at the expense of the Major Prize winner.
All components of the Major Prize must be taken together as a single trip to be booked by the Promoter. Any part of the Major Prize that is not taken for any reason is forfeited.
The Major Prize does not (except as expressly stated) include:
i. any transport between a traveller's residence and the departure airport;
ii. any overnight accommodation while travelling to the departure airport or destination;
iii. any other travel or accommodation;
iv. any meals, food or beverages;
v. any incidental hotel charges (such as mini-bar charges, communication services (e.g. telephone and internet/email); in-house movies and games, entertainment services, and laundry services);
vi. any insurance (such as travel or health cover);
vii. any costs associated with any passport, visa, health or other requirements for entry into any foreign country and return to Australia;
viii. any vaccinations or other medical or health related services;
ix. any other ancillary costs which may be incurred by the winner or his/her guests in relation to the Major Prize.
The winner and his/her guests are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. The Promoter will not be responsible or liable if the winner or any of his/her guests is refused entry to the USA, England or China, or is unable to obtain any visas or documentation necessary to travel by the required date. The winner and his/her guests must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. The winner may be required to present a valid credit card at time of accommodation check in.
If for any reason the winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
In the event of war, terrorism, state of emergency, disaster or other circumstances beyond the reasonable control of the Promoter, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
$200 GIFT CARD DRAWS AND PRIZES
There are 35 x $200 Virgin Australia Travel Vouchers (each a 'Gift Card') to be won. The total value of the Gift Cards is $7,000. Each day of the Entry Period, one instant win draw time will be randomly allocated. The first valid entry received at or after each winning time will instantly win a Gift Card. The instant win draws will occur randomly each day via computer generated random instant win at Prime Focus, 500 Chapel Street South Yarra VIC 3141.

PRIZES GENERALLY
The total prize pool value is $38,000 RRP.
There is one prize pool with 36 prizes in total.
Each prize is valued as at 01/11/16 at Australian prices in AUD$. The Promoter takes no responsibility for any variations in value of any prize.
If a prize (or part of a prize) is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Competition. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if a prize (or part of a prize) is unavailable for any reason.
A right to receive a prize is not transferable or exchangeable and cannot be taken as a monetary payment.
If the winner of a prize is under 18 years of age, the prize will be awarded to a parent or guardian of the winner, as determined by the Promoter, on the winner's behalf.
WINNERS
Each winner will be notified in writing which will be sent by e-mail to the e-mail address indicated in the entry, if it was submitted using the internet.
The notification will include instructions as to how the winner is to claim the prize and establish his/her entitlement to it.
The names of all prize winners will be published at www.m-ms.com.au within 7 days of the prizes being won (including in a redraw under condition 40), for a period of at least 28 days and the Major Prize Winner's name and suburb will be published in The Australian on 11/09/17.
Subject, where relevant, to any directions given under the legislation regulating the Competition, if any prize is not claimed by a winner within 3 months of the draw for that prize, the prize will be awarded to another Eligible Entrant in a redraw for any unclaimed prizes commencing 12 noon on 01/12/17 at the Draw Location. No compensation will be payable to any person whose entry is drawn but who does not claim their prize.
In order to be entitled to any prize, each winner must, if requested by the Promoter, agree to and sign and return:
(i) an eligibility form confirming their compliance with the Conditions and eligibility to accept the prize; and
(ii) a liability release, waiver and/or indemnity in favour of the Promoter and/or any person or other entity associated with this Competition.
If a winner is under 18 years of age, the winner must ensure that his/her parent or guardian agrees to and signs the documents referred to above (if requested by the Promoter). A winner will forfeit his/her prize if he/she fails to ensure that all documents relating to that prize are signed and returned in accordance with this condition, as and when required by the Promoter.
GENERAL
Eligible Entrants may win a limit of one (1) Major Prize and one (1) $200 Virgin Australia Travel Voucher in the Competition.
If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication including any SMS communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition.
CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION, TO CAUSE DAMAGE TO OR TO INTERFERE WITH THE FUNCTIONING OF THE SMS PROCESSES, OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH AN ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
All of the Promoter’s decisions are final and no correspondence will be entered into.
The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the Competition. Entrants should obtain independent tax and financial advice.
To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competition or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify an Australian entrant’s rights under the Competition and Consumer Act 2010.
If any provision of these conditions is unenforceable for any reason, it will be severed and the remaining provisions will remain in full force and effect.
Each winner of a prize consents to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without remuneration for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products.
Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise its winner(s) and, if an entrant consents, may be used to market its products to the entrant. The personal information of each winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter by post at the address stated in condition 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize.
