An entrant must submit their email address to the Kitchen Warehouse mailing list as a method of entry. The customer must agree to subscribe to the Kitchen Warehouse mailing list as part of this process. Entrants can unsubscribe from the Kitchen Warehouse mailing list at any time by selecting the ‘unsubscribe’ option within the body of Kitchen Warehouse emails.
The promotion commences at 12:00 AWST on 17/10/2022 and closes at 23:59 AWST on 13/11/2022 (“the Promotion Period”). The claim period commences at 12:00 AWST on 14/11/2022 and closes at 23:59 AWST on 05/12/2022 (“the Claim Period”).
To be eligible to enter, individuals must enter their email address to the Kitchen Warehouse mailing list at www.kitchenwarehouse.com.au/October-Giveaway. Page live upon commencement of competition at 12:00 AWST on 17/10/2022. No purchase required.
Entrants will be notified via email from Kitchen Warehouse upon entry.
Entrants must ensure that the email address they have provided is valid. The promoter accepts no responsibility for contact details that are entered incorrectly. In the event that contact with the winner cannot be made, the promoter reserves the right to forfeit the winner’s prize, upon three failed attempts to contact the winner.
As mentioned in clause 8, winners will be contacted via email. Winners are responsible for checking their inbox and checking spam and junk accounts, should initial contact be missed. The Promoter is not responsible for any winner’s failure to locate missed emails or answer emails sent by the Promoter in relation to the claiming of a prize.
Winners have up until the 5th of December 2022 to claim their prize from Kitchen Warehouse.
If the selected winner cannot be contacted, is eligible, or fails to claim the prize by the 5th of December 2022, the prize will be forfeited and an alternate winner will be selected in a redraw. The Kitchen Warehouse Social Media Manager will redraw the winner(s) at random on Tuesday 6th December 2022 at 12pm AWST via LiveStream on the Kitchen Warehouse https://www.facebook.com/KitchenWarehouse/ using https://www.random.org/ at Kitchen Warehouse Head Office (1 Pensioner Guard Road, North Fremantle WA 6159). Redraw winners will have up until 20th December to claim their prize.
The prize is final and cannot be exchanged for cash or any other product. The promoted will cover all freight costs for the prize to be sent to the winners. The promoter accepts no responsibility for prizes lost due to change of address or contact details, and there are no replacement prizes. The promoter needn’t accept responsibility should the prize become lost, stolen or damaged during delivery to the winner.
The Promoter reserves the right, at any time, to verify the validity of claims and claimant’s (including a claimant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. A winner must ensure they bring identification with them upon collection of their voucher.
The Promoter’s decision is final, and no correspondence will be entered into.
If the gifts are unavailable, the Promoter, in its discretion, reserves the right to substitute the gifts with a gift to the equal value and/or specification.
Gifts are not transferable or exchangeable and cannot be taken as cash.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose only, and will not disclose such PI to third parties.
