Top Parks is offering you the chance to win one of two $500 Top Park holiday vouchers by simply telling us in 25 words or less what your most memorable experience was in a caravan park in Australia.
These are the terms and conditions of the Promotion. Participation in the Promotion is deemed to be acceptance of these terms and conditions.
- This Promotion is conducted by Top Tourist Parks of Australia Pty Ltd (ABN 34 006 902 727) of 49 Henry Street Stepney South Australia 5069 Telephone 08 8363 1901 ("the Promoter").
- All residents of Australia aged 18 and above are eligible to enter the Promotion ("Eligible Entrant") excluding the following persons: Members of the Promoter; directors, employees and contractors of the Promoter, its Members, advertising agencies and suppliers associated with the Promotion and their immediate families. "Immediate family" includes any of the following relationships: spouse, ex-spouse, de facto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, aunt, uncle, niece, nephew, sibling, step sibling or first cousin.
- The Promotion commences at 4:00pm ACST on Monday 18 December 2017 and closes at 11:59pm ACST on Monday 8 January 2018 ("the Promotion Period").
- The Prize is one of two $500 Top Parks holiday gift vouchers. The Prizes will be made available for delivery to the Winner by registered post to the Winner's place of residence in Australia as specified in the winning entry.
- If the Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority
- The Prize is non-transferable and there is no cash alternative in place of the stated Prize.
- Eligible Entrants may participate in the Promotion by telling us in 25 words or less during the Promotion Period what your most memorable experience was in a caravan park in Australia.
- Entrants are only eligible to make one entry into the Promotion Draw per email address. Only the first valid entry will be accepted.
- Entry is by visiting the Promotion website TopParks.com.au/competitions/summer-holiday during the Promotion Period and entering the information requested, including telling us in 25 words or less what your most memorable experience was in a caravan park, the name of the Eligible Entrant, the address, telephone number and e-mail address of the Eligible Entrant, the age range of the Eligible Entrant, type of accommodation preferred and if a Top Parks Club member or not. The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any entry if the Promoter reasonably considers the entry is invalid for any reason.
- The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and reserves the right in its sole discretion, to disqualify any Eligible Entrant who the Promoter has reason to believe has breached these terms and conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights, including its right to recover damages, or other compensation from such an offender are reserved.
- Entries are deemed to be received at the time of receipt into the Promotion database and NOT at the time of transmission by the Eligible Entrant. Confirmation of receipt of an entry will be sent by e-mail in respect to each entry, but the sending of such e-mail shall not be regarded as conclusive evidence of the validity of an entry.
- Incomplete or indecipherable entries will be deemed invalid.
- The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure, or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
- All valid entries have an equal chance of winning the Prizes. The Winner will be selected based on relevance to holiday parks, safe language, story creativity/memorability.
- The selection process will be conducted by Top Parks staff based on the criteria in clause 15 and shall take place at midday ACST on Friday 12 January 2018 at the office of the Promoter, 49 Henry Street Stepney South Australia 5069.
- The total prize pool is $1000.
- The Winner will be notified by post, telephone and e-mail by no later than 5:00pm ACST on Friday 12 January 2018. The Winner's name and address will be published on Facebook on Friday 12 January 2018 as well as on the Promotion website for 28 days after the Promotion Draw.
- The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.
- If the Winner does not claim the Prize by 30 April 2018, then the Prize shall be forfeited and the Promoter will arrange for an indepedent person to conduct a further draw at midday ACST on Tuesday 1 May 2018 at the same place as the original draw. The Winner as determined by this unclaimed prize draw will be notified by post, telephone and e-mail by no later than 5:00pm ACST on Tuesday 1 May 2018. The Winner's name and address will be published on the Top Parks Facebook pager on Friday 4 May 2018 as well as on the Promotion website for 28 days after the unclaimed prize draw.
- The Winner agrees to the use of their name, image and photograph/s for publicity and promotional purposes, without compensation, and agree that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s.
- If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Entrants; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
- Any cost associated with accessing the Internet is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Eligible Entrant invalid.
- Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees, contractors and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
- Except for any liability that cannot by law be excluded, including the Non- Excludable Guarantees, the Promoter (including its respective officers, employees, contractors and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these terms and conditions; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use of a prize.
- Subject to this paragraph, all personal information collected from Eligible Entrants will be handled in accordance with the Promoter's Privacy Policy which can be accessed by visiting www.topparks.com.au. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant, in addition to any other use that may be outlined in the Promoter's Privacy Policy. Eligible Entrants should direct any request to opt out, access, update or correct information to the Promoter. Any complaints regarding the treatment of personal information should also be directed to the Promoter using the contact details set out in these terms and conditions and will be dealt with by the Promoter in accordance with its Policy. All entries become the property of the Promoter. The Promoter will not disclose any personal information overseas.
