Promotion commences at 12:00am AEDST on 12/10/2016 and final entries close at 8:59:59pm AEDST on 06/12/2016 (“Promotional Period)
To enter, individuals must complete the following steps during the Promotional Period:
a. Spend $20 or more in a single transaction on fuel at a Participating Caltex Service Station in Australia during the Promotional Period (“Eligible Transaction”). A “Participating Caltex Service Station” will be any Caltex Service Station, Caltex Woolworths Petrol Service Station and any independent distributor in Australia that displays promotional Caltex material advertising this promotion. Entrants must ensure that they receive and retain a purchase receipt for their Eligible Transaction; and then
b. Visit win.caltex.com.au, follow the prompts to the promotional entry page and:
i. input all of the requested personal details;
ii. state if they have purchased Caltex Vortex Premium fuel (including Caltex Vortex 98, Caltex Vortex 95 or Caltex Vortex Premium Diesel) as part of their Eligible Transaction.
iii. submit the fully completed entry form; and
iv. if prompted on screen after form submission, upload a copy of their purchase receipt for the Eligible Transaction. Only selected entrants will be required to upload their purchase receipt after entry form submission, as determined by the Promoter in its absolute discretion.
Where applicable, purchase receipts must be uploaded in PDF, JPEG or PNG and must not exceed 3MB.
Once an entrant completes the steps outlined in clause 4 above, they will receive an entry (or entries) for an Eligible Transaction on the following basis:
i. one (1) entry will be awarded in respect of each Eligible Transaction, regardless of the amount spent on fuel in that Eligible Transaction in excess of $20 (“Initial Entry”); and
ii. two (2) bonus entries will also be awarded in the event that the entrant has purchased a Caltex Vortex Premium fuel (including Caltex Vortex 98, Caltex Vortex 95 or Caltex Vortex Premium Diesel) in that Eligible Transaction (“Bonus Entry”).
Further to clause 5, multiple entries permitted, subject to the following: (a) only one (1) Initial Entry and two (2) Bonus Entries permitted per Eligible Transaction, regardless of the amount spent on fuel in that Eligible Transaction in excess of $20; and (b) an entry in respect of each Eligible Transaction must be submitted separately and in accordance with entry requirements.
Entrants must retain their original Participating Caltex Service Station purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry. All provisional winners, excluding any entrant that has already provided their purchase receipt(s) for all of their entries, will be required to provide their proof of purchase to the Promoter via one (1) of the following methods, so that it is received by 11.59pm AEDST on 22/03/2017:
a. By following the prompts in their winner notification email to upload a copy of their purchase receipt; or
b. By mailing in their purchase receipt, together with a piece of paper specifying their name and address, to Handling Matters, PO BOX 6324, FRENCHS FOREST NSW 2086.
Minor Draws
There will be fifteen (15) minor draws conducted each day of the Promotional Period (each a “Minor Draw”), for a total of eight hundred and forty (840) Minor Draws. The first Minor Draw conducted each day will comprise all entries received between 9pm the previous day and 6:59:59am that morning, with the exception of the first Minor Draw of the Promotional Period, which will include the entries received between 12:00am and 6:59:59am that day. Entries into each subsequent Minor Draw each day will open and close every hour between 7:00am and 8:59:59pm that day. For the sake of clarity, the second Minor Draw each day will comprise all entries received between 7:00am and 7:59:59am that day, the third Minor Draw each day will comprise all entries received between 8:00am and 8:59:59am that day, etc. All times indicated are in AEDST, as applicable in NSW. Entries in each Minor Draw will not be entered into any subsequent Minor Draw/s, however, all entries received during the Promotional Period will be entered into the Major Prize Draw (defined below). Prime Focus, on behalf of the Promoter, may draw additional reserve entries in each Minor Draw and record them in order in case an invalid entry or ineligible entrant is drawn. The winner of each Minor Draw will be notified in writing by email within two (2) business days of the draw and their name will be announced online at win.caltex.com.au, starting from 14/10/2016, and then each Friday after that until 09/12/2016.
Each Minor Draw will be conducted at Prime Focus, Level 1, 500 Chapel Street, South Yarra 3141 as soon as entries close for that Minor Draw, with the first Minor Draw taking place at 7:00am AEDST on 12/10/2016 and the last Minor Draw taking place at 9:00pm AEDST on 06/12/2016. The Promoter may draw additional reserve entries in each Minor Draw and record them in order in case an invalid entry or ineligible entrant is drawn.
In the event there are no entries received for a particular Minor Draw, the prize corresponding to that Minor Draw will be entered into the unclaimed prize draw (as indicated in clause 25).
The first valid entry drawn in each Minor Draw will each win a $100 Caltex StarCash Card. Any ancillary costs associated with redeeming a StarCash card are not included. Any unused balance of a StarCash card will not be awarded as cash and will be forfeited. Redemption of a StarCash card is subject to any terms and conditions of the issuer including those specified on the StarCash card. Each StarCash card expires on the last day of the month stated on the reverse of the StarCash card, or if no month is stated, 12 months after the date of receipt of the StarCash card.
Major Draw
There will be one (1) major draw conducted from all entries received during the Promotional Period (“Major Draw”). The Major Draw will take place at Prime Focus, Level 1, 500 Chapel Street, South Yarra 3141, at 12pm (noon) AEDST on 07/12/2016. Prime Focus, on behalf of the Promoter, may draw additional reserve entries in the Major Draw and record them in order in case an invalid entry or ineligible entrant is drawn. The winners will be notified in writing by email within two (2) business days of the draw and their name will be announced online at win.caltex.com.au, from 08/12/2016.
The first three (3) valid entries drawn in the Major Draw (each a “Participant”) will each win the opportunity to play a contingency game (“the Game”) for the chance to win $1,000,000. A total of three (3) Participants will be selected in the Major Draw.
The Game will take place at a date between 12/12/2016 and 22/12/2016, a time between 6.00am and 9.00pm AEDST and at location in Sydney NSW, as determined by the Promoter and published online at win.caltex.com.au no later than 12/10/2016. In order to participate in the Game, if the drawn Participant resides outside of NSW, he/she will receive two (2) return economy airfares from his/her nearest capital city in Australia to Sydney, one (1) night accommodation at a hotel determined by the Promoter and return airport transfers, valued at up to $1,500 depending on point of departure (“Travel Prize”). If the drawn Participant resides within NSW, the Participant will be responsible for transport to and from the Game. Spending money, meals, taxes (excluding airline and airport taxes), insurance, transport to and from departure point, transfers, items of a personal nature (including but not limited to in-room charges) and all other ancillary costs are not included. If the drawn Participant cannot attend the Game, the Participant may appoint a proxy over 18 years of age to play the Game on his/her behalf provided the Participant gives the Promoter written, signed notice to that effect before the start of the Game. In the event that the Promoter has not been able to contact the Participant before the start of the Game, a representative of the Promoter will play the Game on the Participant’s behalf.
During the entire duration of the Travel Prize, a nominated parent/guardian must accompany any person under 18 years of age. The winner of the Travel Prize and his/her companion must depart from and return to the same departure point and travel together. The winner of the Travel Prize may be required to present their credit card at time of accommodation check in. Changes to travel dates and/or accommodation after booking confirmation are not possible. The Promoter takes no responsibility for missed connections, flights and mishaps while undertaking the prize, lost baggage or person or property mishaps. All travel will be booked by the agency specified by the Promoter and is subject to availability.
If any Participant is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the Participant’s behalf.
Each Participant will be required to choose a number between 1 and 100, or to select a token out of 100 tokens (as directed by the Promoter) at the start of the Game. One (1) number from 1 to 100, or 1 token out of 100 tokens (as applicable, depending on the exact mechanics of the Game determined by the Promoter and published online at win.caltex.com.au on or before 12/10/2016) will contain a promotional message representing $1,000,000. The other 99 numbers or tokens (as applicable) will each contain a promotional message representing $10,000. The Participant/proxy/representative (“Attendee”) must choose only one (1) number or token (as applicable) without handling or interfering in any way with any of the other numbers or tokens (as applicable). If the Attendee is found to have breached this condition, he/she will be disqualified. If the Attendee selects the number or token (as applicable) containing the promotional message representing $1,000,000, then, subject to verification by the judges, the drawn Participant will win $1,000,000. If the Attendee selects a number or token (as applicable) containing a promotional message representing $10,000, then the $1,000,000 prize will not be given away and, subject to verification by the judges, the drawn Participant will win $10,000.
Each Participant will play the Game in accordance with the above, with a new set of numbers or tokens (as applicable) provided in each case (i.e. each Participant will be required to chose one (1) number between 1 and 100 or one (1) token out of 100 tokens, as determined by the Promoter).
Each drawn Participant’s odds of winning the 1,000,000 are 1 in 100. The odds of being drawn as a Participant may be significantly higher than the odds of the drawn Participant winning the major prize, and will depend upon the number of entries received.
General
Incomplete, indecipherable or illegible entries will be deemed invalid.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The Promoter’s decision is final and no correspondence will be entered into.
Subject to the unclaimed prize draw clause, if for any reason a winner does not take and/or redeem a prize (or an element of a prize) at or by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total potential maximum prize pool value is up to $3,088,500. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
A re-draw for any prizes that remain unclaimed as at 11.59pm AEDST on 22/03/2017 may take place on 23/03/2017 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners (if any) will be notified in writing within two (2) business days of the draw and their name will be published online at win.caltex.com.au, from 30/03/2017. For the avoidance of doubt, in the event that any Participant selected in the Major Draw fails to claim their prize, the prize awarded in the unclaimed prize draw will be the prize chosen by the Attendee at the Game for that Participant. .
As a conditions of accepting a prize, all Minor Draw winners, Participants and Attendees (and the Participants’ companions for the Travel Prize where applicable): (a) agree to participate in reasonable promotional activities, including photography/video sessions, interviews and appearances organised by the Promoter (including being filmed during the Game, where applicable); and (b) consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media (including but not limited to the Promoter’s social media pages, radio and television) for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter; and (c) agree that the Promoter has all editorial control over material featuring them and any such material will not be subject to their prior approval.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking or use of a prize or participating in a Game.
As a condition of accepting a prize, each winner (and the winner’s proxy and companion, where applicable) must sign any legal documentation as and in the form required by the Promoter, interviewers and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to related entities, agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing the requested PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.caltex.com.au/Pages/PrivacyPolicy.aspx. If the entrant opts in at the time of entry, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter may disclose entrant’s PI to overseas entities, see the Privacy Policy for more details.
