TERMS & CONDITIONS:
1. Information on how to enter and prizes form part of these conditions. By submitting a photo captioned #OpticWhiteSmile #OpticWhiteRacing on Facebook or Instagram and otherwise participating in this competition, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.
Entry is open to winners of the Colgate Optic White Smile Ambassador Instagram and Facebook #Promotion who accepted a prize in accordance with the terms and conditions of that promotion.
TERMS & CONDITIONS:
1. Information on how to enter and prizes form part of these conditions. By submitting a photo captioned #OpticWhiteSmile #OpticWhiteRacing on Facebook or Instagram and otherwise participating in this competition, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.
Entry is open to winners of the Colgate Optic White Smile Ambassador Instagram and Facebook #Promotion who accepted a prize in accordance with the terms and conditions of that promotion.
2. To enter, each entrant must, during the Entry Period:
(1.a) Access your own personal Facebook account, upload a photo with a post telling us how you get race day ready with Colgate Optic White and include the hash tags #OpticWhiteSmile and #OpticWhiteRacing. Ensure that your posts and photos are made ‘public’ when posting your entries, so they are viewable for judging; OR
(1.b) Access your own personal Instagram account, upload a photo with a post telling us how you get race day ready with Colgate Optic White and include the hash tags #OpticWhiteSmile and #OpticWhiteRacing. Ensure that your posts and photos are made ‘public’ when posting your entries, so they are viewable for judging.
“Platform” means Facebook or Instagram, as applicable.
Multiple entries will be accepted, however, each entry must be unique and submitted separately
3. Entries must be received by the Promoter during the Entry Period. Entries received after 8th September 2016 at 11.59pm AEST will not be accepted.
4. The competition commences at 12.01am AEST on 22/08/16 and closes at 11.59pm AEST on 08/09/16 (“Entry Period”).
5. This competition is a game of skill. Chance plays no part in determining the winners. All entrants will be judged individually on their merits based on who best represents the Colgate Optic White brand. Photographs which feature more than one person will be judged based on the individual entrant and only the entrant will be eligible to win the prize. Further, each image will only be eligible to win once, even if the same image is submitted by multiple entrants (e.g. group photos).
The judges’ decision is final and binding – no correspondence will be entered into.
6. Judging will take place 09/09/16 at Unit 4, 52 Queen Street, Beaconsfield NSW 2015. Entries will be judged by a panel of judges from Colgate-Palmolive and The Conversion Group. The best 1 entry overall, received during the Entry Period, as determined by the judges, will receive the prize. There is 1 prize to be won.
7. By uploading a photograph to enter in accordance with clause 2, each entrant agrees that:
(1.a) the photograph may be made available for public viewing on www.colgateopticwhitecomp.com.au(“Website”) and the Platform through which the entry was submitted;
(1.b) each person depicted in the posts uploaded must be decently dressed and presented and the photograph must not be inappropriate, derogatory or otherwise offensive to any person;
(1.c) all photographs are subject to the approval of the Promoter. The Promoter reserves the right to vet all entries at any time and may request the removal of any entries from Facebook or Instagram at any time in its absolute discretion. However, the Promoter is not responsible for any photographs uploaded to any Platform or the Website and visitors to each site view it at their own risk;
(1.d) entrants must own the copyright in the photograph uploaded or be entitled and have permission to use the photograph in the manner contemplated by these terms, including use of the photograph for promotional purposes in accordance with clause 16 and clause 17;
(1.e) the entrant has the permission of each other person featured in the photograph, or, if any other person is under the age of 18, the permission of their parent or legal guardian, to enter the photograph in accordance with these terms and conditions, including consent to each condition in this clause 7; and
(1.f) the entrant has notified each other person featured in the photograph, or, if any other person is under the age of 18, that person’s parent or legal guardian, of the Promoter’s privacy policy (available at www.colgate.com.au/app/Colgate/AU/Corp/LegalPrivacy.cvsp) and each person or parent or legal guardian (as the case may be) has agreed to that privacy policy.
8. The winner will receive an upgrade to the Colgate Optic White Marquee at Royal Randwick, Saturday 17th September, for the winner and their four friends, including:
5 x tickets to the Colgate Optic White Marquee which also includes access to the general admission and members areas at Royal Randwick;
5hr food and beverage package for 5 people;
Complimentary parking for 5 cars;
5 racebooks; and
Entertainment inside the marquee.
Total RRP value of the prize is = $2,075
All taxes (excluding GST) which may be payable as a consequence of receiving the prize are the sole responsibility of the winner.
Prize winner must be available to attend the Colgate Optic White Stakes Day on the 17th September 2016, at Royal Randwick, Sydney and is responsible for getting themselves and their 4 guests to and from the event. All other ancillary costs including but not limited to flights, insurance, taxes (excluding GST), meals, drinks, transfers and any and all other expenses which may be incurred as a consequence of receiving the prize are the responsibility of the winner. The winner and any other person sharing the prize with the winner must be over the age of 18 years.
The winner of this upgrade will be notified by the Promoter in accordance with clause 12 on the 9th September 2016. The winner must provide the Promoter with the names and dates of birth of their 4 friends who will be sharing the prize with the winner by the 12th September 2016.
All taxes (excluding GST) which may be payable as a consequence of receiving the prize are the sole responsibility of the winner.
9. Prizes are not transferable and are not redeemable for cash.
10. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may modify, cancel, terminate or suspend the competition.
11. If any prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value.
12. The winner will be notified via the contact details provided to the Promoter when awarded a prize in the Colgate Optic White Smile Ambassador Instagram and Facebook #Promotion on 9th September 2016. If the Promoter is unable to contact the winner on 9th September 2016, the winner will be notified via the platform that their entry was submitted to on 12th September 2016, in accordance with the below:
(a) Facebook – via direct private message to the winner’s profile. The winner must respond to the private message within 1 day in order to verify their identity and provide their email address, phone number and postal address in order to receive the prize; and
(b) Instagram – via a direct private message to the winner’s account. The winner acknowledges that, in order to receive the message from the Promoter the winner must accept the Promoter’s request to “follow” in their request queue. The winner must respond within 1 day to the private message in order to verify their identity and provide their email address, phone number and postal address in order to receive the prize.
The name of the prize winner will be published on the Website by 14/09/16. Prize will be delivered to the winner by 16/09/16.
13. If a winner does not respond to the Promoter’s direct private message in accordance with clause 12, that winner will forfeit the prize and the prize will be awarded to the next best entry (as determined by the judges). The Promoter will not be liable for a winner who does not respond to the Promoter’s direct private message and therefore forfeits their prize and no correspondence will be entered into.
14. Before the prize is awarded, the winner and all other persons sharing the prize with the winner may be required to sign an agreement to release the Promoter and/or third party prize suppliers from any liability arising from the acceptance, use of or participation in the prize.
15. The Promoter reserves the right to request verification of age, identity, email address of the winner and any other information from entrants relevant to entry into or participation in this competition, including proof that the winner is actually featured in the winning photograph. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with the conduct of this competition.
16. Entrants consent to the Promoter using their name, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
17. Entrants confirm and promise that their entry is original and does not infringe the intellectual property rights of any third party. Further, entrants agree that the Promoter has an unrestricted, irrevocable, transferable, divisible right and licence to use and modify their entry for the purposes of the Promoter’s business including for promotional purposes without the payment of any further fee or compensation. If requested by the Promoter, the entrant agrees to sign any further documentation required by the Promoter to give effect to this arrangement. To the extent permitted by law, entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their entry.
18. The prize is subject to the terms and conditions of the Australian Turf Club. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner as a result of the conduct of The Australian Turf Club or otherwise as a result of the winner accepting and/or using a prize (even if caused by negligence), except for any liability which cannot be excluded by law.
19. Entrants acknowledge that use of the Platforms is subject to the terms and conditions of that Platform. The Promoter is not responsible or liable for any loss, damage or injury suffered by any entrant as a result of the conduct of any of the Platforms, including the decision of any Platform to remove or not remove any photographs, except for liability which cannot be excluded by law.
In particular, the thoughts and views expressed on each of the Platforms are only the thoughts and views of the individual that posted them. They are not representative of the opinions of the Promoter, nor does the Promoter confirm, guarantee or warrant the accuracy, completeness or usefulness of any post. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. It is a condition of entry that each entrant grants a complete release to Facebook from any claims that they now have or may have in the future which relate to or are incidental this promotion.
20. Entries remain the property of the Promoter. Details from entries will be collected and used for the purposes of conducting this competition (which may include disclosure to third parties for the purpose of processing and conducting the competition) and for promotional purposes surrounding this competition. By entering this competition entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional purposes without any further reference or payment to the entrant. Entrants may access, change and/or update their personal information and obtain a copy of the Promoter’s privacy policy and Privacy Collection Statement by contacting the Promoter on (02) 9229 5600 during office hours or visiting www.colgate.com.au/app/Colgate/AU/Corp/LegalPrivacy.cvsp.
