Entry is open to residents of Australia who are 18 years of age or over (“Entrants”). The Promoters are Virgin Australia Airlines Pty Ltd (ABN 36 090 670 965) of 56 Edmondstone Road, Bowen Hills, Queensland 4006 and Etihad Airways New Airport Road, Khalifa City A, P.O. Box: 35566, Abu Dhabi, UAE.
The directors, officers, management and employees (and their immediate families) of the Promoters and its related bodies corporate are eligible to enter the competition.
The competition commences at 12:00 pm AEST on 11 June 2014 and ends at 12:00 pm AEST on 10 July 2014 (“Competition Period”). Winners will be selected from 12:00 pm AEST on 18 July 2014.
To enter the competition, Entrants must: (a) Submit an original image taken by the Entrant and describe why this image represents a ‘best seat’ in the house in 25 words or less via the competition website http://ngx.me/lGx7Zq during the Competition Period; and (b) register their details as requested on the competition website including, but not limited to, name, email address and phone number.
There is a limit of one entry per person for the duration of the Competition Period.
Entries will be deemed accepted at the time of receipt by the Promoters and not at the time of transmission. Entries received will be considered final by the Promoters. Illegible, incomprehensible and incomplete entries will be deemed invalid. The Promoters accept no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction or otherwise including those entries not received by the Promoters
By entering this promotion Entrants expressly consent to allow the Promoter to display their entry (including but not limited to the image and 25 words or less) in a public competition gallery online. Before entries are displayed publicly on the online competition gallery the Promoter will approve each Entry before they are shown publicly. Entries will display in the gallery within 48 hours of submission.
Costs associated with accessing the competition website remain an Entrant’s responsibility and may vary depending on the Internet service provider used.
The winners will be announced on the Virgin Australia and Etihad Airways Australia Facebook page on 21 July 2014. The winning entries will be on the Promoters’ Facebook page and via the Promoters’ Twitter account and Instagram account. The winners expressly consent to allow the Promoter to display their entry on the Promoters’ Facebook page and via the Promoters’ Twitter account and Instagram account
Entries not fully complying with these Conditions of Entry may be deemed invalid at the Promoters discretion. If a winning entry is deemed not to comply with these Conditions of Entry, the entry will be discarded and the relevant prize will be re-awarded in accordance with the relevant clause of these Conditions of Entry as if the discarded entry had not been received.
Four winners will be chosen from all entries received and judged by a professional photographer appointed by the Promoters. All decisions of the Promoters and professional photographer are final and no discussions or correspondence will be entered into.
This is a game of skill and chance plays no part in determining the outcome. The criteria for judging will be based on, among other things, originality, creative merit and relevance. There will be four winners chosen
Images submitted must be clear and relevant to the topic ‘best seat’. Any images containing inappropriate or offensive material will be deemed invalid. If images showcase people other than the Entrant, the Entrant must seek approval from those appearing in the image before entering this promotion.
There are four prizes to be won: For each prize the winner will be allowed to take 1 companion (together referred to as the Winner) to any ticketed event unless sold out anywhere on the Virgin Australia or Etihad Airways network, flown in the business class cabin (based on availability, aircraft type and schedule) from the Winner’s (not the companion’s) nearest Virgin Australia serviced airport within Australia, and 3 nights standard room accommodation in a minimum 4 star hotel in the city where the event is taking place The event must fall between 1 September 2014 and 30 November 2014 with all travel completed by 30 November 2014 (Travel Period). Should the event take place over several days, the Winner will only be entitled to a 1 day pass for that event. If the Winner is unable to travel within the Travel Period, the prize will be re-allocated by the Promoters. An example of a prize: a Winner may select to attend the F1 Etihad Airways Abu Dhabi Grand Prix on 20 November 2014 flying from Sydney to Abu Dhabi on Etihad Airways in business class. Average total prize value is up to $15,000 AUD (excluding GST). The prize is not exchangeable and cannot be taken as cash.
The Winner must notify the Promoter within 14 days of being awarded as a winner, the name of their companion, nominated ticketed event they’d like to attend, destination and nearest Virgin Australia serviced airport within Australia.
The Promoter will use its best endeavours to find tickets to the nominated event. Should tickets not be available or be sold out, the Winner must within 2 days suggest an alternative event to the Promoter. The Winner must keep suggesting an alternative event to the Promoter within 2 days of the Promoter notifying the Winner that tickets to the alternate event are not available or sold out.
Flights are subject to Virgin Australia and Etihad Airways terms and conditions of carriage which are located on the Virgin Australia website and can be found at www.virginaustralia.com and the Etihad Airways website and can be found at www.eithad.com. If for any reason, the Winner does not, once the flights, accommodation and event tickets have been booked, take the flight at the time stipulated, then their prize will be forfeited and cannot be redeemed for cash. Once travel itinerary including flights, accommodation and event tickets have been issued, no changes to the itinerary or name changes will be allowed.
It is the Winner’s responsibility to ensure that they have requisite visas, vaccinations, valid documentation (including but not limited to valid passports and visas) which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the Winner.
The Winner is responsible for all other expenses including but not limited to spending money, meals, drinks, transfers, laundry charges, activities, incidentals, taxes, energy surcharges, gratuities, service charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination or as part of the prize. The Promoter makes no representation or guarantee that it will be able to obtain tickets to the event or any alternative events nominated by the Winner.
Prizes will be awarded to the Entrant named in the entry.
Should an Entrant’s contact details change during the Competition Period, it is the Entrant’s responsibility to notify the Promoters. A request to access or modify any information provided in an entry should be directed to the Promoters.
By accepting the prize, the winners agree to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed. The winners will not be entitled to any fee for participating in these activities.
As a condition of entering this competition, the Entrant warrants to the Promoters that: (a) The entry does not infringe the intellectual property rights or moral rights of any third party; and (b) The image is taken by the Entrant, the Entrant owns the image and it is an original image of the Entrant; and (c) The Entrant has obtained permission from any third party appearing or particpating in the entry.
As a condition of entering this competition, Entrants hereby assign to the Promoters, all right, title and interest in and to all copyright in any material created pursuant to the Entrant’s participation in any aspect of the competition (“Works”). Entrants acknowledge that the Promoters are free to use the Works and to exercise its rights in relation thereto and the Entrant will not be entitled to any fee for such use.
Entrants agree they may not be attributed as the author of the Works and that the Promoters may undertake any act or omission in relation to the Works, which may otherwise constitute an infringement of their moral rights.
In consideration for the Promoters awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in any media whatsoever throughout the world for an unlimited period and the winner will not be entitled to any fee for such use.
The Promoters reserve the right to request Winners to provide proof of identity, proof of age, proof of residency and/or proof of entry validity (including but not limited to originality of image) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoters. In the event that a Winner cannot provide suitable proof, the Winner will forfeit the prize in whole and no substitute will be offered.
The Promoters reserve the right to verify the validity of entries and to disqualify any entry which in the opinion of the Promoters, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Conditions of Entry or who has, in the opinion of the Promoters, engaged in conduct in entering the competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the competition and/or the Promoters. The Promoters reserve the right to disqualify a Winner if the Promoters become aware that the Winner and/or the Winner’s entry is of a type described in this clause. Any entrant disqualified under this clause is prohibited from any further participation in this competition.
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoters ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoters may in their absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
The Promoters, its associated agencies and companies (and their respective officers, employees and agents) exclude all liability (including negligence) except for any liability that cannot be excluded by law, for any direct, indirect or consequential injury, loss and/or damage arising in any way in connection with this competition or any prize/s. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect or inaccurate or incomplete information communicated in the course of, or in connection with, this competition as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize claims or prizes; (iv) acceptance and/or use of any prize (including but not limited to any component of a Winner’s trip).
The Promoters reserve the right in their sole discretion to disqualify any individual who the Promoters have reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of this promotion. Any entrant disqualified under this clause is prohibited from any further participation in this competition. The Promoters legal rights to recover damages or other compensation from such an offender are reserved.
The Promoters and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, internet failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
If for any reason this competition is not capable of running as planned, including due to infection by computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any causes beyond the control of the Promoters, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this competition, the Promoters reserve the right in their sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to any written direction given under State Regulation.
The Promoters are not liable for any tax implications arising from prize winnings. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
All entries will be the property of the Promoters. The Promoters are bound by the Privacy Act 1988 including the Australian Privacy Principles. The information Entrants provide will be collected for the purpose of conducting this competition and managed in accordance with the Promoter’s Privacy Policy (Virgin Australia’s Privacy Policy is available at www.virginaustralia.com.au and Etihad Airway’s Privacy Policy is available at http://www.etihad.com/en-au/legal/privacy-policy/). Entry is conditional on providing this information. The Promoters may disclose entrants’ personal information to each other, their contractors and agents to assist in conducting this competition or communicating with Entrants. The Promoters may also disclose Entrants’ personal information to its related companies and third parties who provide (or help Virgin Australia or Etihad Airways provide) products and services, some of whom may be located overseas. The Promoter may disclose entrants’ personal information to persons or organisations located in the United Arab Emirates, Germany, India, Ireland, Israel, Malaysia, New Zealand, Singapore, the Philippines, United Kingdom and United States of America. Entrants consent to the Promoters using their personal information for future promotional and marketing purposes regarding the Promoter’s products and services, including contacting the entrant via SMS and email messages (and entrants consent to receiving such messages from the Promoter). Information on how to opt-out from these messages is set out in the Promoter’s Privacy Policies. The Promoter’s Privacy Policies also explain how an entrant can seek to access or correct any personal information the Promoter holds about the entrant, how to complain about a privacy breach by the Promoter and how the Promoter will deal with a privacy complaint. Entrants can contact the Promoters in relation to its handling of personal information at privacy@virginaustralia.com and socialmedia@etihad.ae.
By entering the competition, each Entrant also agrees that the Promoters may use their personal information, for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the Entrant commercial electronic messages. Entrants acknowledge and agree that the Promoters do not need to include an unsubscribe facility in any commercial electronic messages it sends.
Entrant’s personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoters.
