4. Eligible Entrants
4.1 The Promotion is only open to individuals who:
(a) are Australian residents aged 18 years or over; and
(b) are not otherwise ineligible or excluded under these Terms and Conditions,
(“Eligible Entrants”).
4.2 Employees (and their immediate families) of the Promoter, and those of the agencies and suppliers associated with this Promotion, are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. How to enter
5.1 To enter, Eligible Entrants must complete the following steps during the Promotional Period:
(a) Purchase 30 litres or more of any Shell fuel (excluding LPG and AdBlue and excluding purchases made with Shell Card, Fleet Card, Motorcharge or Motorpass) in a single transaction from a participating “Shell” or “Shell Coles Express” service station in Australia. For participating service stations, see “Participates in Viva Energy promotions” at shell.com.au/motorists/fuel-finder.
(b) Retain the original or a copy of the purchase receipt issued by the participating service station on payment as proof of purchase (with the Eligible Entrant being responsibile for requesting a purchase receipt if one is not provided at the time of purchase). If the Eligible Entrant is unable to provide evidence of a purchase transaction to the Promoter’s reasonable satisfaction through the provision of the purchase receipt, the Promoter may determine the Eligible Entrant’s entry to be invalid (thereby forfeiting any rights to claim a Prize).
(c) Visit www.shell.com.au/grandfinal and follow the prompts to the Promotion entry page and complete the online entry form, including by (without limitation):
• inputting the requested details (including their full name, email address, phone number and the full purchase receipt number and site number, as shown on the purchase receipt);
• inputting the type of Shell fuel purchased;
• uploading a copy of the purchase receipt; and
• submiting the fully completed online entry form.
5.2 Eligible Entrants who purchase 30 litres or more of a premium Shell fuel (being Shell V-Power 98, Shell V-Power Diesel or Shell Premium Unleaded 98) in a single transaction and correctly input this information on the online entry form submitted in accordance with section 5.1 above, will receive a bonus entry (Bonus Entry).
5.3 As part of the entry process, Eligible Entrants must consent to receiving communications from the Promoter regarding offers, promotions, goods and services and other promotional materials.
5.4 Multiple entries during the Promotional Period are permitted, subject to the following conditions:
• only one (1) entry permitted per purchase transaction (regardless of how many litres of Shell fuel over 30 litres is purchased in that transaction);
• only one (1) Bonus Entry permitted per purchase transaction (regardless of how many litres of Shell V-Power 98, Shell V-Power Diesel or Shell Premium Unleaded 98 fuel over 30 litres is purchased in that transaction); and
• each entry must be submitted separately and in accordance with all entry requirements.
6 Entry procedures
6.1 Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission by the Eligible Entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.
6.2 The Promoter has no control over the communications networks that may be used to enter the Promotion and is not liable for any problems associated with them due to network traffic congestion, technical malfunction or otherwise. For clarity, the Promoter is not liable for any consequences of user error including (without limitation) costs incurred. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure, or otherwise. Incomplete or indecipherable entries will be deemed invalid.
6.3 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, contact details and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of this Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
6.4 If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
6.5 The Promoter’s decision is final and no correspondence will be entered into.
7. The Draw
7.1 The draw will take place at Anisimoff Legal, Suite 5/210 Central Coast Highway, Erina NSW 2250 on Thursday, 8 September 2022 at 3pm AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
7.2 The first valid entry drawn will win four (4) category one tickets to the 2022 Toyota AFL Grand Final and the Grand Final breakfast; four (4) flights from their nearest capital city; twin share accommodation (two rooms) and transfers to and from the airport and accommodation, valued at up to $23,570 depending on point of departure (Major Prize).
7.3 The next two (2) valid entries drawn will each win one (1) $2,500 DoorDash voucher for use in catering an AFL party to be held by each winner at their nominated residence. This must occur on Saturday 24 September 2022, with the time of delivery and items to be supplied to be organised and determined by the winners directly with DoorDash. This Prize consists of items delivered by DoorDash only, up to the value of $2,500, and the Promoter has no responsibility for, or liability in connection with, the holding of the ‘AFL party’, for which each winner is fully responsible. Gift Card is redeemable towards eligible orders placed on www.doordash.com or in the DoorDash App in Australia. Gift Cards are made available and provided by DoorDash, Inc. Gift Cards cannot be used to pay a credit account and are not redeemable for cash except when required by applicable law. Purchases with Gift Card are subject to DoorDash standard refund policy, and any refund amounts will be credited back to the DoorDash consumer account. 7.4 The next ten (10) valid entries drawn will each win their choice of either one (1) Shell Coles Express Gift Card to the value of $100 OR one (1) DoorDash voucher to the value of $100. These winners will need to nominate which of these vouchers they would like to receive when they are contacted by the Promoter.
7.5 Each winner of a Prize must be able to provide the Promoter with a copy of the purchase receipt used to enter the Promotion in order to claim their Prize. Purchase receipt(s) must clearly specify that the purchase was made at a participating service station during the Promotional Period but prior to entry.
7.6 The Major Prize winner, and the three (3) people nominated by that winner to participate in receiving the Major Prize (Recipients), must be available to travel to Melbourne, Victoria between 23 to 25 September 2022. These dates are not negotiable and cannot be changed under any circumstances by the Major Prize winner or any Recipients.
7.7 The Major Prize winner must provide the Promoter with their full name, as well as the full names of each Recipient, in order for air travel and accommodation to be booked. For the avoidance of doubt, the Recipients will be chosen by the Major Prize winner in the Major Prize winner’s absolute discretion and the Promoter accepts no responsibility in regards to the Major Prize winner’s choice of Recipients.
7.8 No part or the whole of the value of the Major Prize can be transferred to any other person or exchanged for cash. Spending money, meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included unless specified otherwise. The Major Prize winner and their companions must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the Major Prize unless specified otherwise. Major Prize is subject to the standard terms and conditions of individual prize and service providers. Major Prize winner may be required to present their credit card at time of accommodation check in.
7.9 To the fullest extent permitted by law, the Promoter is not liable for failure by the Major Prize winner or any Recipient to use or take the benefit of any part or the whole of the Major Prize, including (without limitation) where that failure arises as a direct or indirect result of any fraud, theft, illness, loss, act or omission by or of the Recipient, the Major Prize winner or any third party, or from any act of God.
7.10 Redemption of a Shell Coles Express Gift Card can only be done at Shell Coles Express service stations and are subject to the terms of use of the issuer, which can be found at https://www.giftcards.com.au/CMS/Page/giftcardtermsofuse, as well as any terms specified on the Shell Coles Express Gift Card itself.
7.11 Redemption and use of each prize, and entry into, and participation in, all activites forming part of a prize, are subject to the terms and conditions of the prize issuer and any terms shown on any ticket forming part of the prize.
7.12 As a condition of accepting the Major Prize, the winner and each of their Recipients must sign any legal documentation as and in the form reasonably required by the Promoter and/or Prize issuers, including but not limited to a legal release and indemnity form.
7.13 The winners will be notified by email within two (2) business days after the draw and their names will be published online by Monday, 12 September 2022 at http://shell.com.au/winners.
8. The Prizes
8.1 Each of the prizes described in section 7 (“The Draw”) of these Terms and Conditions is a “Prize” for the purposes of these Terms and Conditions.
8.2 Any ancillary costs associated with redeeming vouchers or gift cards or any other benefit forming part of a Prize are not included in the Prize. Any unused balance of these Prizes will not be awarded as cash.
8.3 The total prize pool value for this Promotion is $29,570 AUD. Prizes, or any unused portion of a Prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. Winners cannot swap or choose their Prize.
8.4 If any Prize (or part of any Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or similar specification (which, for the purposes of these Terms and Conditions, is also a Prize), subject to any legislative restrictions or directions from a relevant regulatory authority.
8.5 If for any reason, a winner does not arrange with the Promoter (or its agencies) for the receipt of their Prize (or any element of their Prize) by the date that falls one (1) week after the Prize draw, then their Prize will be deemed to be unclaimed.
8.6 A redraw for any unclaimed Prizes may take place on Thursday, 15 September 2022 at the same time and place as the original draw, subject to any legislative restrictions or directions from a relevant regulatory authority. Winners, if any, will be notified by email within two (2) business days after the redraw and their names will be published online by Monday 19 September 2022 at http://shell.com.au/winners.
9. Privacy
9.1 On entry into, or registration for, the Promotion, an Eligible Entrant’s personal information will be collected by the Promoter and stored on the Promoter’s database. The Promoter obtains personal information about an Eligible Entrant to enable them to participate in the Promotion. Any failure by an individual to complete all the mandatory fields when entering or registering, will prevent them from being able to participate in the Promotion. The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its privacy policy which is located at https://www.vivaenergy.com.au/contact/privacy-policy. This privacy policy contains information about how a person may seek access to and correction of their personal information and how to make complaints. It also contains information about how a person can request their personal information not be used for direct marketing purposes and details of other organisations to whom the Promoter usually discloses personal information. If the Eligible Entrant has provided consent to receiving offers and promotions from the Promoter, the Promoter may use information the Eligible Entrant provides for its own future marketing purposes regarding its products/services, including contacting the Eligible Entrant electronically about other future special offers.
10 General terms
10.1 Any person who claims a Prize agrees to and must participate in, and co-operate with, as reasonably required by the Promoter (or its agencies) all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
10.2 If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any legislative restrictions or written directions from a relevant regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
10.3 Any cost associated with accessing the websites or any other entry mechanisms for the Promotion, is the entrant’s responsibility and is dependent on the Internet service provider used.
10.4 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or under any similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).
10.5 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury or any other loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way in connection with the Promotion, including (without limitation) due to: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of or taking of a Prize.
