Promotional Period
The Promotion commences at 9AM (AEDT) on 12/12/18 and closes at 11.59pm (AEDT) on 01/01/19.
Eligible Entrants
Entry is open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter, its related entities and any agencies associated with this Promotion are ineligible to enter.
Entry
To enter, each Eligible Entrant must, during the Promotional Period:
Purchase any Aperol or Aperol Spritz product in one transaction (Qualifying Transaction) at any participating Bottlemart or Sip 'n Save store where the POS is displayed; and
Visit www.bottlemart.com.au or www.sipnsave.com.au, follow the prompts to the competition entry page, input the requested details and submit the fully completed entry form online
Eligible Entrants must retain the original receipt for their Qualifying Transaction as proof of purchase and produce this within 7 days of a request by the Promoter. Failure to do so may, in the sole discretion of the Promotor, result in invalidation of the entrant’s entry and forfeiture of any right to a prize.
Entries which in the reasonable opinion of the Promoter:
are received outside the Promotional Period;
contain defamatory, offensive or inappropriate content or infringe intellectual property rights;
are incomplete or indecipherable; or
do not otherwise comply with these terms,
will be invalid and ineligible for any prize.
Only 1 entry permitted per Qualifying Transaction. Each entry must be submitted separately. A maximum of 2 entries per person per day is permitted.
Draw
The Draw will be conducted at 586A Pittwater Road, North Manly NSW 2100 at 10:00am (AEDT) on 03/01/19, by way of an electronic random draw.
An independent scrutineer will observe the Draw process and announcement of the winner.
The first valid entry randomly drawn will win the Prize (Winner).
The Promoter may at any time (including after the Promotional Period), verify the validity of entries and entrants and disqualify any individual who the Promoter reasonably believes has breached any of these terms or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion.
If there is a dispute as to the identity of an entrant, the Promoter may, in its sole discretion, determine the identity of the entrant.
Prize(s)
The Winner will receive a trip for 2 people to The Australian Open in Melbourne. The total prize is valued at $4,900 (recommended retail price).
The prize consists of:
Economy flights for 2 adults aged 18 years or over from your nearest capital city to Melbourne
Return private transfer from Melbourne airport to hotel in Melbourne
2 nights hotel accommodation at QT hotel Melbourne based on twin share (check in: 26th January and check out 28th January 2019)
2 Tickets to The Australian Open Mens final 27th January 2019
VIP entry into Club Aperol on Sunday 27th January
$300 Spending money issued on Eftpos credit card
The Winner and their travelling companions must travel at the same time, depart from the same capital city and are responsible for:
transport from their residence to their nearest capital city for flight departure; and
costs associated with redeeming the prize, including expenses with respect to food and beverages, travel insurance, where such costs are not covered by the Spending Money.
It is personal responsibility of the Winner and their companions to ensure that they have valid documentation, including valid passports and visas, which meet the requirements of immigration and other government authorities. Any fines, penalties, payments or expenditures incurred as a result of such documents failing to meet these requirements will be the sole responsibility of the travellers. The Winner agrees to present their credit card or a cash deposit upon arrival at any accommodation to cover all ancillary costs they may incur during their stay.
If the Prize is unavailable for reasons outside the Promoter’s reasonable control, the Promoter may substitute the Prize (or a component of the Prize) with a prize of equal value and/or specification, subject to any written directions from a regulatory authority.
Notification of Winner
The Winner will be notified in writing and by telephone on the same day of the Draw. Their name will also be published on www.aperolausopen.com.au on 3rd January 2019.
The Australian Open takes place on a fixed date outside of the Promoter’s control. Accordingly, in the event that the Winner cannot be contacted, the Promoter will retain the Prize for (7) seven days from the date of the Draw. If the Prize is not claimed within this time, the Promoter will re-draw another winner for the unclaimed Prize at 586A Pittwater Road, North Manly NSW 2100 at 10am (AEDT) on 11th January 2019 by way of a random draw (Re-draw).
The winner of the Re-draw will be contacted in writing and by telephone on the same day of the Re-draw. Their name will also be published on www.aperolausopen.com.au on 11th January 2019.
The Prize (including flights) must be redeemed on 26th January 2019. Tickets for the chosen flights will be emailed to the Winner (or winner of the Re-draw) by 18th January 2019, along with accommodation details.
Privacy
The Promoter will collect, use and disclose your personal information in conducting the Promotion in accordance with its Privacy Policy, available at www.aperol.com/privacy-policy. The Promoter may also use your personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to, or telephoning, you.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a Winner (including photograph, film and/or recording of same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion and any of the Promoter’s products.
Miscellaneous
The Promoter encourages consumers to enjoy liquor responsibly. Consumers of legal drinking age are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines (available at www.nhmrc.gov.au).
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated for any reason beyond the reasonable control of the Promoter including technical difficulties, unauthorised intervention or fraud, the Promoter may, to the extent permitted by law:
disqualify any entrant; or
subject to any written directions from a regulatory authority, modify, suspend, terminate or cancel the Promotion or modify the Prize, as appropriate.
Nothing in these terms limits, excludes or modifies (or purports to do so) any non-excludable guarantees or warranties under consumer law (Non-Excludable Guarantees).
Except for the Non-Excludable Guarantees and any other liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) will not be responsible and excludes all liability (including negligence) for any personal injury or loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of:
the Promotion and/or the taking or use of the Prize;
any technical difficulties or equipment malfunction outside of the Promoter’s reasonable control;
any theft, unauthorised access or third party interference;
any late, lost, altered or misdirected entries for any reason beyond the Promoter’s reasonable control;
any tax liability incurred by a Winner or entrant; and/or
any damage to or delay in transit of the Prize during delivery,
except to the extent caused or contributed to by the Promoter.
