“DORITOS CRACKERS X PEDESTRIAN.TV: MIDNIGHT SNACKIN’ PROMOTION”
TERMS AND CONDITIONS
The promoter is Pedestrian Group Pty Limited ACN 112 839 568 of Level 5, 60-64 Reservoir Street, Surry Hills NSW 2010 (“Promoter”).
By entering this Competition, entrants agree to be bound by these Terms and
Conditions. Information on how to enter and prize form part of these Terms and Conditions. All times are Australian Eastern Daylight Savings Time (AEDST) unless otherwise advised.
Entry is open to Australian residents aged 18 years and over. Employees of
Promoter and the suppliers and agencies associated with this Competition, and the immediate family of all such employees are ineligible. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, stepgrandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, stepsister or 1st cousin.
The Competition starts at 12:00 hours on 14th May 2018 and ends at 11:59
hours on 29th May 2018 (“Promotional Period”). This Competition will be
conducted during the Promotional Period. Entries must be received by the
Promoter during the Promotional Period. Entries received after the Promotional
Period will not count towards the Competition.
To enter, individuals must during the Promotional Period, undertake the following steps:?Input the requested details, one of which will be “What is the most insane way you’d crack into a box of Doritos Crackers?” in 25 words or less via a free text field. An additional non-mandatory field will allow the entrant to also submit an image/video “showing” their answer to the above for the chance to win an additional major prize. There may be image/video size restrictions; adherence of which is the responsibility of the entrant. Submit the fully completed online entry form. Only one (1) entry is permitted per person per email/mailing address.
A valid entry needs to adhere to local and federal Australian laws and regulations, and restrictions with the safety of entrants and the general public in mind at all times; and otherwise comply with these Terms and Conditions.
Any entries which contain content that is unlawful, fraudulent, breaches intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, indecent, profane, abusive, harassing, threatening, and/or objectionable with respect to race, religion, origin or gender will be removed by the Promoter and will be deemed invalid. The promoter and The Smith’s Snackfood Company Pty Ltd (ABN 31 057 976 940) (“Smith’s”) do not take any responsibility for any damage and/or injuries that may occur to participant/s of this competition and/or property as a result of creating an entry for this promotion.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves
the right, in its sole discretion, to disqualify any individual who the Promoter has
reason to believe has breached any of these Terms and Conditions, tampered
with the entry process or engaged in any unlawful or other improper misconduct
calculated to jeopardise fair and proper conduct of the Competition. Errors and
omissions may be accepted at the Promoter's discretion. Failure by the Promoter
to enforce any of its rights at any stage does not constitute a waiver of those
rights. The Promoter's legal rights to recover damages or other compensation
from such an offender are reserved.
Entrants consent to the Promoter using the details of their entry,
including any images/video added to the entry, in any media for an unlimited
period without remuneration for the purpose of promoting this promotion
(including any outcome), and promoting any products manufactured, distributed
and/or supplied by the Promoter and/or Smith’s.
Incomplete, indecipherable, inaudible or illegible entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right,
in its sole discretion, to determine the identity of the entrant.
This is a two-tiered prize promotion, meaning there is a minor prize and major prize available:
Up to 100 x minor prize winners will win a double pass to Doritos Crackers & Pedestrian.TV’s Midnight Snackin’ event, which takes place on Wednesday 30 May 2018 (date is subject to change). Each minor prize is valued at $300.00 AUD.
1 x major prize winner will win double pass to Doritos Crackers & Pedestrian.TV’s Midnight Snackin’ event, which takes place on Wednesday 30 May 2018 event (date is subject to change), and return flights from their residential address to Sydney, NSW, Uber transfers, and an overnight stay in a 3.5* hotel the night of the event. Accommodation, transfer and hotel supplier at the discretion of Pedestrian.TV. This major prize is valued is $2,500.00 AUD each.
This promotion is a game of skill and for both prizes, chance plays no part in determining the winner.
For the minor prizing, each entry will be individually judged based on the creativity of the written answer provided in the mandatory “25 Words or Less” text field.
For the major prizing, each entry will be individually judged based on the creativity of the video/image attachment provided in the optional field.
The Promotor advocates safety of the entrant and is not encouraging entries that reflect or support dangerous or illegal activity.
The judging of minor prizing will take place at the Promoter’s office periodically throughout the campaign, to allow winners sufficient notice to attend. The winners will be notified in writing by email by 29th May and the winners must claim the prize as per the instructions provided.
The judging of the major prize will take place on or before 25 May 2018, to allow the winner sufficient notice and travel. The second judging will take place on the 29th may select additional reserve entries, in case of an unforeseen circumstances of winner, invalid entry or ineligible entrant.
Subject to the unclaimed prize draw clause, if for any reason the winner does not take the prize by the time stipulated by the Promoter, then the prize will be
forfeited and the Promoter is not obliged to offer a substitute or compensation.
As a condition of accepting the prize, the winner must sign any legal
documentation as and in the form required by the Promoter and/or prize suppliers
in their absolute discretion, including but not limited to a legal release and
indemnity form that releases the promotor and Smith’s.
Maximum prize pool value is $300 AUD (minor prizing) and $2,500 AUD (major prizing) respectively. The prize, or any unused portion of the prize, is not transferable or exchangeable.
Entrants consent to the Promoter using their and their plus one(s) name, likeness, image and/or voice in the event they win and attend the event (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter and/or Smith’s.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Smith’s (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Smith’s (including their respective officers, employees
and agents) are not responsible for and exclude all liability (including negligence),
for any personal injury; or any loss or damage (including loss of opportunity);
whether direct, indirect, special or consequential, arising in any way out of: any technical difficulties or equipment malfunction (whether or not under the
Promoter’s control); (b) any theft, unauthorised access or third party interference;(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the
reasonable control of the Promoter; (d) any variation in prize value to that stated
in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant;
or (f)use of the prize.
The Promoter collects personal information ("PI") in order to conduct the
promotion and may, for this purpose, disclose such PI to third parties, including
but not limited to Smith’s, agents, contractors, service providers, prize suppliers and, as
required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.pedestrian.tv/privacy-policy (the Promoter). In
addition to any use that may be outlined in the Privacy Policies, the Promoter
may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contain information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose Personal Information to any entity outside of Australia.
